The bill makes widow and widower's benefits available to disabled individuals at any age, whereas currently the benefits are limited to such individuals between ages 50 to 60. Provisions reducing benefits in various instances, such as when a beneficiary is entitled to multiple types of benefits, shall not apply to widow and widower's benefits for individuals with disabilities. For determining whether a beneficiary has a child in his or her care, the bill raises the upper age limit for the child from 16 to 18 years (or 19, if the child is a full-time elementary or secondary school student). An individual with a child in care may receive increased benefits in specified instances. The bill also increases various limits on widow and widower's benefits in certain instances and modifies the calculation for increased benefits for individuals who choose to delay receiving such benefits. For current beneficiaries, increases in OASDI benefits under this bill shall not affect the beneficiary's eligibility for any federal assistance program or the benefit amount to be received under such an assistance program. 2023-01-11T13:41:21Z

Specifically, the bill: applies the judicial code of conduct applicable to U.S. judges to administrative law judges (ALJs) for the SSA, prohibits the SSA from prescribing certain fees regarding the representation of claimants for OASDI and SSI benefits, permits the SSA to withhold less than the amount required to correctly adjust a recipient's OASDI benefits amount under certain conditions, disqualifies an individual from receiving OASDI benefits for any month for which the individual receives unemployment-insurance benefits, eliminates the application stages for reconsideration reviews of disability determinations, increases the frequency of benefits-eligibility reviews, and decreases the amount of time provided to an individual to apply for OASDI benefits and receive funds retroactively from the first month of eligibility.Additionally, the SSA must: review a sample of decisions in favor of claimants for OASDI benefits from outlier ALJs, update the medical-vocational guidelines used in disability determinations, consider any relevant evidence from a claimant's social media prior to issuing a disability determination, update the data used to determine the full range of work available to individuals in the national economy, ensure that communications between the SSA and an individual eligible for OASDI benefits include a description of the individual's responsibility to report to the SSA on any change of circumstance that may affect such individual's eligibility, and include unearned income in the determination of an individual's substantial gainful activity. 2023-01-11T13:41:57Z

The Bureau of Labor Statistics shall publish a Consumer Price Index for Elderly Consumers, which the Social Security Administration  (SSA) shall use to calculate cost-of-living adjustments to benefits. Currently, the SSA uses a price index for wage earners to make such adjustments. The bill increases the minimum benefit amount for individuals who worked for more than 10 years by creating an alternative minimum benefit. A qualifying beneficiary shall receive that alternative minimum if it is higher than the standard calculated benefit amount. The bill increases the income threshold that a beneficiary must reach before Social Security benefits are taxable. Increased benefits from this bill shall not count as income when determining an individual's eligibility or benefit amounts for (1) Medicaid, (2) the Children's Health Insurance Program, or (3) the Supplemental Security Income program. Income above $400,000 shall be included when calculating Social Security benefits and taxes. The bill also increases rates for the payroll and self-employment taxes that fund OASDI. With respect to housing, the bill: phases out the federal mortgage-interest income-tax deduction, replacing it with a new mortgage-interest income-tax credit; expands the federal low-income housing income-tax credit; expands certain affordable-housing programs; and establishes a federal income-tax credit for low-income renters. With respect to employment, the bill: expands unemployment compensation benefits; establishes several new employment-related programs to be carried out by the Department of Labor; establishes a tax credit for employers that hire long-term unemployed individuals; establishes prohibitions on employment discrimination based on an individual's status as unemployed; increases the federal minimum wage, incrementally over a period of seven years, to $15.00 per hour. In addition, the bill: expands the federal earned-income tax credit, makes refundable a federal income-tax credit for dependent care expenses, and expands eligibility for certain child-care benefits. The bill requires grantees to continue to track and demonstrate, on a triennial basis, improvement in applicable benchmark areas. A grantee that fails to do so must develop and implement a corrective action plan, subject to approval by the Department of Health and Human Services (HHS). HHS shall terminate a program grant made to a grantee that implements such a plan but continues to fail to demonstrate improvement. As a condition for receiving grant funds under the program, a state must review and update its statewide needs assessment by October 1, 2020. A grantee may use a portion of program grant funds to support a "pay-for-outcomes initiative" (a performance-based grant, contract, or cooperative agreement, awarded by a public entity, in which a commitment is made to pay for improved outcomes that result in social benefit and public-sector cost savings).
