The EPA must: (1) carry out a research and development program for carbon dioxide utilization to promote technologies that transform carbon dioxide generated by industrial processes into a product of commercial value, and (2) support activities relating to carbon dioxide utilization by providing technical and financial assistance. The bill amends the Fixing America's Surface Transportation Act to apply the Act's accelerated environmental review and permitting procedures to the construction of infrastructure that captures, utilizes, or sequesters carbon dioxide and the construction of carbon dioxide pipelines. The Council on Environmental Quality (CEQ) must publish guidance to: (1) facilitate reviews associated with the deployment of carbon capture, utilization, and sequestration projects and carbon dioxide pipelines; and (2) support the efficient, orderly, and responsible development of such projects and pipelines. Gibbs, Bob [R-OH-7] OH R G000563 6 Water Infrastructure Improvement Act (Sec. 3) This bill amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to allow municipalities to develop a plan that integrates wastewater and stormwater management. A permit for a municipal discharge under the national pollutant discharge elimination system that incorporates an integrated plan may integrate all requirements under the Act addressed in the plan, such as requirements relating to combined sewer overflows, sanitary sewer collection systems, and total maximum daily loads. A plan that is incorporated into a permit may include the implementation of green infrastructure and projects to reclaim, recycle, or reuse water. Green infrastructure includes measures that mimic natural processes to store, reuse, or reduce stormwater. Those permits may include a schedule of compliance that allows actions for meeting water quality-based effluent limitations to be implemented over more than one permit term if the compliance schedules are authorized by state water quality standards. A municipality under an administrative order or settlement agreement may request a modification of the order or settlement based on the municipality's integrated plan. The EPA must report on each integrated plan developed and implemented through a permit, order, or judicial consent decree since June 5, 2012, including a description of the control measures, levels of control, estimated costs, and compliance schedules for the requirements implemented through such a plan. (Sec. 4) The bill establishes an Office of the Municipal Ombudsman in the Environmental Protection Agency (EPA) to provide: (1) technical assistance to municipalities seeking to comply with the Clean Water Act, and (2) information to the EPA to ensure that agency policies are implemented by all EPA offices. For chemicals that are found to pose an adverse health risk, the EPA shall identify and do additional review on facilities that are significant sources of the chemical to determine whether the facility poses an adverse public health risk. Under the bill, chemicals identified as carcinogenic in the system must have a toxic chemical release form completed by the owner or operator of a facility. The bill requires the Department of Health and Human Services (HHS) to consult with appropriate EPA offices regarding the future schedule of assessments of chemicals to be conducted under the system, the results or existing assessments, and concerns that may merit additional review. HHS must also administer personal exposure tests for chemicals that pose a new adverse public health risk to vulnerable populations, such as children. The EPA must ensure that: (1) EPA's Office of Water, Office of Enforcement and Compliance, Office of Research and Development, and Office of Policy promote the use of the infrastructure in, and coordinate the integration of, permitting programs, planning efforts, research, technical assistance, and funding guidance; and (2) the Office of Water supports establishing innovative financing mechanisms in the implementation of the infrastructure. The EPA must: (1) direct each EPA regional office to promote and integrate the use of the infrastructure within the region, and (2) promote sharing information about the infrastructure approaches. The departments must establish a program under which the departments may enter into habitat reserve agreements with property owners to protect or manage habitat for endangered or threatened species. The departments: (1) may provide conservation grants to promote the voluntary conservation of endangered species and threatened species by property owners, (2) must provide financial aid to alleviate the costs of complying with the Act, and (3) may provide technical assistance when requested to enhance the conservation effects of the grants or aid. The bill expands requirements regarding providing notice of a proposed regulation that determines whether a species is endangered or threatened, including by requiring the appropriate department to provide notice to each person who requests a notice. Under candidate conservation agreements and safe harbor agreements, property owners enter into agreements with the Department of the Interior or the Department of Commerce, as appropriate, to address the needs of endangered, threatened, or candidate species in exchange for assurances regarding resource use restrictions that might be imposed if circumstances change. Each incidental take permit, candidate conservation agreement, and safe harbor agreement must contain certain assurances governing permit revocation, changed circumstances, and unforeseen circumstances as prescribed by the bill. The U.S. Fish and Wildlife Service must establish Theodore Roosevelt Genius Prizes for: (1) prevention of wildlife poaching and trafficking, (2) promotion of wildlife conservation, (3) management of invasive species, (4) protection of endangered species, and (5) nonlethal management of human-wildlife conflicts. Ellison, Keith [D-MN-5] MN D E000288 53 Water Affordability, Transparency, Equity, and Reliability Act of 2018 This bill amends the Internal Revenue Code to: (1) establish a Water Affordability, Transparency, Equity, and Reliability Trust Fund; and (2) increase the corporate income tax rate to 24.5% to provide revenues for programs created by this bill. The Environmental Protection Agency (EPA) and the Department of Agriculture must allocate funds from the trust fund to clean water programs, drinking water programs, and water well systems. The bill amends Federal Water Pollution Control Act (commonly known as the Clean Water Act) to authorize the EPA to make grants for providing technical assistance for water and sanitation infrastructure and drinking water systems to rural and small municipalities and tribal governments. The EPA must establish a grant program for repairing, replacing, or upgrading septic tanks and drainage fields. The bill amends the Consolidated Farm and Rural Development Act to make permanent a grant program for household water well systems in rural areas. The bill revises requirements concerning the clean water state revolving fund (SRF) and the drinking water SRF. The bill amends the Safe Drinking Water Act to require the EPA to make grants to local educational agencies for: (1) infrastructure to ensure that drinking water in schools is lead free, and (2) testing drinking water in schools for lead. 2023-01-11T13:39:47Z
