It also provides statutory authority for and expands the types of civil actions that may be brought for violations. For example, the bill expands provisions under the Civil Rights Act of 1964 so as to (1) prohibit federally funded programs from discriminating based on sex or religion; and (2) prohibit public accommodations, including stores and transit services, from discriminating based on sex. The bill defines sex to include sex stereotypes, pregnancy, childbirth, sexual orientation, gender identity, and sex characteristics. It also expands the definition of race to include traits that have been historically associated with race (e.g., natural hair textures). The expanded definitions apply to the Civil Rights Act of 1964, the Fair Housing Act (discrimination in public and private housing), and Title IX of the Education Amendments of 1972 (discrimination based on sex in federally funded educational programs). Further, the bill provides statutory authority for disparate impact or intentional discrimination claims under the aforementioned acts, as well as the Age Discrimination Act of 1975 (discrimination based on age by federally funded programs) and the Rehabilitation Act of 1973 (discrimination based on disability by federally funded programs). However, a state may (1) restrict abortions after viability, except when a pregnancy endangers the life or health of the woman; and (2) enact regulations to further the health or safety of a woman seeking an abortion, except for unnecessary health regulations that present a substantial obstacle to a woman seeking an abortion. Additionally, the bill provides statutory authority for the Court's holdings in Griswold v. Connecticut (the right of married couples to obtain contraception), Eisenstadt v. Baird (the right of single persons to obtain contraception), Carey v. Population Services International (the right of minors to obtain contraception), and Whole Woman's Health v. Hellerstedt (that certain state restrictions on abortion facilities and providers created an undue burden). The bill allows the Department of Justice or any person adversely affected by a state law that violates this bill to seek injunctive relief. The bill requires the Department of Justice to issue regulations requiring government entities and insurance providers to offer community-based long-term services to individuals with such disabilities who would otherwise qualify for institutional placement. Government entities must ensure sufficient availability of affordable, accessible, and integrated housing that is not a disability-specific residential setting or a setting where services are tied to tenancy. Regulations shall also (1) require government entities and insurance providers to perform self-evaluation on current services, policies, and practices and concerning compliance with requirements of this bill; and (2) require government entities to submit a transition plan. The bill provides funds for FY2022 for the Department of Health and Human Services to provide technical assistance with respect to transition plans. Government entities must ensure sufficient availability of affordable, accessible, and integrated housing that is not a disability-specific residential setting or a setting where services are tied to tenancy. Regulations shall also (1) require government entities and insurance providers to perform self-evaluation on current services, policies, and practices and concerning compliance with requirements of this bill; and (2) require government entities to submit a transition plan. The bill provides funds for FY2022 for the Department of Health and Human Services to provide technical assistance with respect to transition plans.
