(A forage fish is any fish at a low trophic level that contributes significantly to the diets of other fish, marine mammals, or birds and serves as a conduit for energy transfer to species at a higher trophic level.) The Department of Commerce must establish guidelines to assist regional fishery management councils in (1) developing a list of unmanaged forage fish areas and prohibiting the development of any new forage fish fisheries until the potential impacts of such fisheries have been assessed; and (2)setting annual catch limits for forage fish fisheries that assess, specify, and reduce such limits by the diet needs of other fish species and marine wildlife. The bill adds shad (American shad and hickory shad)and river herring (blueback herring and alewife)to the list of managed stocks for the New England and Mid-Atlantic Fishery Management Council. 2023-01-11T13:43:46Z

Steel-jaw leghold traps are certain spring-powered devices with steel jaws that are designed to snap closed on animals. Conibear traps consist of metal frames hinged at the center point and powered by two torsion springs that create a scissor-like action designed to kill an animal by snapping its spine. Cage traps, box traps, suitcase-type live beaver traps, and mouse or rat snap traps are not included in the ban. The bill establishes penalties for violating this ban. The Department of the Interior must pay a reward for information that leads to a conviction of a violation of this bill, unless the information was provided by on duty officers or employees of federal, state, or local governments. Specifically, the bill makes permanent the requirement for the Department of State to identify certain countries that are major sources, transit points, or consumers of wildlife trafficking products. Additionally, the State Department, on any State Department website or web-based application providing country-specific information for international travel, must ensure that such countries are clearly identified with a warning label along with a warning that international law or U.S. law may prohibit the export, import, purchase, sale, possession, or transport of products produced from endangered or threatened wildlife. In addition, the bill revises the duties of the Presidential Task Force on Wildlife Trafficking. Among other duties, the task force must assess how consumption of illegally tracked wildlife in the United States may be driving illegal wildlife trafficking in such countries. The bill also authorizes citizen suits to enforce the Animal Welfare Act. Dealers and exhibitors must apply to USDA for licenses or renewal licenses each year. Before issuing or renewing licenses, USDA must conduct unannounced facility inspections. USDA must deny an application for a new license if the applicant fails to meet animal welfare standards during a second inspection, a renewal license if the applicant violates such standards in more than one inspection in the previous two years, or a new or renewal license if the dealer or exhibitor has violated laws relating to animals or if the issuance of the license would facilitate the circumvention of state or local laws that prohibit the private ownership of certain animals. Further, USDA must suspend the licenses of dealers or exhibitors whose violations present a risk to animal welfare. USDA must revoke the licenses if the violations persist or if the licensees commit multiple violations. Dealers and exhibitors with suspended or revoked licenses may not be (1) granted another license, (2) granted another license through another person or entity, or (3) employed by another licensee to work with animals during the period of the suspension or revocation. 2022-11-01T13:50:08Z

Act This bill establishes requirements to protect dogs from dog dealers who have had their licenses suspended or revoked in the last 10 years and certain individuals connected to such dog dealers. Specifically, the bill prohibits the Department of Agriculture (USDA) from licensing such a dealer if the license is for operating a facility that the dealer previously used for dogs. Further, for such a facility, USDA may not license (1) the dealer's immediate family members, (2) persons who reside at the same address as the dealer, or (3) certain legal entities where the dealer holds an ownership interest. 2022-11-01T15:32:53Z
