"Buddy" [R-GA-1] GA R C001103 0 TSA Screening Transparency and Accountability Act This bill directs the Transportation Security Administration (TSA), consistent with the General Accountability Office's November 2015 report on the Screening Partnership Program (SPP), to update its cost estimating methodology for federal cost estimates and cost comparisons to conform to certain minimum leading cost estimating best practices, including by: incorporating a cost estimate that reflects the total cost to the federal government, including costs incurred by federal agencies other than TSA; ensuring all TSA cost estimates are adjusted for inflation over the duration of the contract; updating all cost estimates when circumstances at a SPP airport result in a significant change to a contract's value; including an analysis that identifies which variables have the greatest effect on cost estimates; and reflecting the inherent uncertainty associated with the cost estimate and identifying the elements of the estimate that present the most risk. TSA shall make the update available to the public. TSA shall develop a streamlined method and standard protocol for documenting, tracking, and resolving customer complaints for both federal and SPP airport checkpoints. TSA shall make available to airport directors, managers, and other individuals in similar positions cleared to handle sensitive security information an assessment of each airport's security screening performance compared to the mean average performance for all equivalent airports. 2023-01-11T13:33:54Z

Schatz, Brian [D-HI] HI D S001194 7 Strengthening American Transportation Security Act of 2016 This bill expresses the sense of Congress that the personnel system used by the Transportation Security Administration (TSA) provides insufficient workplace protections for its workforce and such personnel should be entitled to protections under the civil service system applicable to all federal employees. The bill repeals personnel authorities of the Department of Homeland Security (DHS) and the Department of Transportation governing the conditions of employment for TSA employees, thus making TSA employees subject to the personnel management system applicable to all other federal employees. Within 60 days after the enactment of this bill or an earlier date set by DHS: (1) all TSA personnel management policies, directives, letters, and guidelines and any DHS human resources management system shall cease to be effective with respect to TSA employees; and (2) TSA employees shall become subject to labor provisions applicable to other federal transportation employees. The bill sets forth transition rules that protect the pay rates and other rights of TSA employees. DHS shall consult with the labor organization certified by the Federal Labor Relations Authority to carry out the conversion of TSA employees and positions to the civil service system. DOT shall withhold 10% of a state's apportionment of certain federal-aid highway funds if the state has not enacted a law that requires the employer to conduct background checks before hiring school bus drivers. DOT shall also withhold 10% of a state's apportionment of certain federal-aid highway funds if the state has not enacted and is not enforcing a law that imposes specified first offense and second offense civil and criminal penalties for motorists found guilty of illegally passing a stopped school bus. The bill amends the Vision 100--Century of Aviation Reauthorization Act to revise contents of an annual Department of Transportation report to Congress regarding an integrated work plan for the NextGen. The plan shall include, among other things, a description of the progress made in meeting NextGen performance goals relative to the performance metrics. The bill revises requirements for the award of bonuses to the FAA Chief NextGen Officer. The FAA, for purposes of the award of such bonuses, shall also consider any progress made toward meeting the NextGen performance goals. Collected fees shall be deposited into a Rail Account established within the Oil Spill Liability Trust Fund and shall be available only for: (1) the payment of removal and remediation costs and other costs, expenses, claims, and damages related to an accident or incident involving the transportation of Class 3 flammable liquids by rail; and (2) DOT grants to states and Indian tribes to develop emergency plans and to train regional hazardous material emergency response teams and public employees responding to such an accident or incident. DOT shall issue such regulations as necessary to require each Class I railroad carrier to inspect all track where an accident or incident involving the transportation by rail of flammable liquids or material poisonous or toxic by inhalation could affect a "high consequence area" (a commercially navigable waterway, an area with a high or concentrated population, or an area that is unusually sensitive to environmental damage). The inspections shall be carried out on foot and by a gage restraint measurement system. An inspector who finds a deviation from requirements regarding track safety standards shall immediately initiate remedial action. The FAA shall review each decision that it made between February 14, 2012, and September 30, 2014, to grant a categorical exclusion with respect to a procedure to be implemented at an OEP airport that was a material change from procedures previously in effect to determine if implementation of the procedure had a significant effect on the human environment in the community in which the airport is located. The bill revises air transportation security program requirements to provide that such programs ensure: law enforcement presence at each airport is adequate to ensure the safety of passengers, as under current law, and their property; close cooperation between all relevant parties in ensuring airport security; high training standards for all security and law enforcement personnel; prompt notification of, and law enforcement response to, any security incidents at airports, including detention of persons who attempt to evade transportation security screening; and multiple means for TSA Officers or members of the public to request prompt law enforcement assistance in the airport. The study shall: focus on residents in Boston, Chicago, New York, the northern California metroplex, Phoenix, and not more than three additional metropolitan areas that each contain at least one international airport; consider the health impacts on residents living partly or wholly within the land area underneath the flight paths most frequently used by aircraft flying below 10,000 feet; and consider only those health impacts that manifest during the physical implementation of the NextGen RNAV program on flights departing from or arriving at an international airport located in one of such metropolitan areas. An institution of higher education is eligible to conduct the study if it: has a school of public health that has participated in the FAA Center of Excellence for Aircraft Noise and Aviation Emissions Mitigation, has a Center for Environmental Health that receives funding from the National Institute of Environmental Health Sciences, is located in one of the areas within the scope of the study, applies to the FAA in a timely fashion, demonstrates that it is qualified to conduct such a study, and agrees to submit its findings to the FAA within two years after entering into such an agreement. 2023-01-11T13:31:33Z
