Thornberry, Mac [R-TX-13] TX R T000238 0 Red River Gradient Boundary Survey Act This bill directs the Bureau of Land Management (BLM) to commission a survey to identify the South Bank boundary line with respect to land along a specified 116-mile stretch of the Red River in Oklahoma and Texas (the affected area). The survey shall: adhere to the gradient boundary survey method; span the length of the affected area; be conducted by surveyors who are licensed and qualified to conduct official gradient boundary surveys, and selected by and operating under the direction of the Texas General Land Office and the Oklahoma Commissioners of the Land Office (the offices); and be completed within two years of enactment of this bill. The BLM shall submit the survey to the offices for approval and, within 60 days of receiving it, they shall determine whether to approve it. Surveys of individual parcels in the affected area shall be conducted according to the requirements for the survey of the South Bank boundary line. A survey of such a parcel shall be approved or disapproved by the offices within 60 days of receipt. The survey for identifying the South Bank boundary line and any survey of an individual parcel shall not be submitted to the BLM for approval. After a survey for an individual parcel has been approved, the offices shall submit to the BLM: a notice of the approval of such survey, and a copy of such survey and any field notes related to the parcel. 2023-01-11T13:33:55Z

The Department of Agriculture (USDA) may carry out management activities to maintain or restore fish and wildlife populations and habitats within the wilderness area if they would: promote healthy, viable, and more naturally distributed populations that would enhance wilderness values; and accomplish the purpose of the management activity with the minimum impact necessary. USDA may take measures within the wilderness area necessary for the control of fire, insects, and disease. Nothing in this bill creates a protective perimeter or buffer zone around the wilderness area. The United Statesmust be represented by five commissioners on the North Pacific Fisheries Commission. Additionally, a permanent advisory committee is established, which shall be comprised of 11 members. Advisory committee members shall represent groups concerned with fishery resources covered by the North Pacific Fisheries Convention. (Sec. 103)The Department of State has the authority to receive and transmit various communications concerning the North Pacific commission, and can approve or disapprove bylaws and rules adopted by the commission. (Sec. 104) The bill details NOAA's authority in implementing this bill and measures adopted by the commission. The Integrated Ocean Observing System (IOOS) is a network of federal and regional entities that provide information about the nation's coasts and oceans, as well as the Great Lakes. The National Oceanic and Atmospheric Administration (NOAA) must: (1) serve as the lead federal agency for the implementation of the IOOS, and (2) establish an IOOS Program Office to oversees daily operations and coordination of the IOOS. The bill outlines the requirements for NOAA as the lead agency. The bill establishes a process for regional associations to certify their regional coastal observing systems. The Joint Subcommittee on Ocean Science and Technology of the National Science and Technology Council must: (1) conduct an Ocean Chemistry Coastal Community Vulnerability Assessment on ocean acidification within a year and every five years thereafter; and (2) develop a plan to deploy ocean acidification sensors prioritized by the threat to coastal economies and ecosystems, gaps in data on ocean acidification, and research needs. The National Science Foundation's research on ocean acidification must include research on: (1) impacts of multiple stressors on ecosystems exhibiting hypoxia (a dead zone that is depleted of oxygen), harmful algal blooms (rapid accumulation of algae), or sediment delivery; and (2) the effects of those impacts combined with changes in ocean chemistry. 2023-01-11T13:34:04Z

No national monuments may be designated by the President unless: each county, borough, parish, or equivalent unit of local government within and adjacent to the boundaries of which the proposed monument is to be located has been consulted respecting the designation and has approved it; and the governor and the legislature of each state within the boundaries of which such monument is to be located has approved it. Any national monument that is designated subject to such requirements shall be open to hunting, fishing, other forms of recreation, grazing, and historic or traditional uses, unless the Department of the Interior, the Department of Agriculture (USDA), or the Department of the Army closes all or a portion of the monument to one or more of such uses in accordance with the purposes of federal law relating to monuments, ruins, sites, and objects of antiquity. The bill ratifies and approves: retroactive to September 26, 2013, the acquisition or purported acquisition by the United States of the land and interests in the Schoodic Peninsula, and any subsequent or purported alteration of the land or interests held or claimed by the United States in the peninsula (including conversion to fee simple interest) retroactive to whatever point an alteration occurred or may have occurred. The Department of the Interior may only acquire land or interests in land: within the boundaries of the park in accordance with specified law; and outside the boundaries of the park in Hancock County, Maine, in accordance with such law. Interior shall contribute a specified amount to a regional consortium which was established to improve the management of the disposal and recycling of solid waste and is composed of municipalities on, as well as near, Mount Desert Island. Interior shall reestablish and appoint members to the Acadia National Park Advisory Commission. Certain land in the park that was conveyed by Interior to the town of Tremont, Maine, shall no longer be used exclusively for school purposes, but for public purposes, subject to the conditions that: (1) use of the property (on such land) shall not degrade or adversely impact the park's resources or values; and (2) such land shall remain in public ownership for recreational, educational, or similar public purposes. 2023-01-11T13:33:42Z

The BLM shall notify affected landowners within 30 days of completion of the resurvey if it extends the boundaries of federal land. If a resurvey results in private land being reclassified as federal land, the affected landowners shall be given the right of first refusal to purchase the land for fair market value minus the value of any significant improvements made to such lands, or be reimbursed for the fair market value of any such improvements. Beginning two years after enactment of this bill: (1) if a permittee has not exercised such option, the Commissioner shall transfer the site to Dickinson Parks & Recreation in Dickinson, North Dakota (the Department), without cost; and (2) the Commissioner shall transfer to the Department, without cost, land currently managed by the Department on which no cabin is located. Each such conveyance and transfer shall be made subject to specified mineral rights and rights-of-way of third parties. A permittee may not build any new permanent structure below an elevation of 2,430 feet. If a permittee builds such a structure, the permittee's site shall revert to the Department. The program shall also have one or more objectives, including to: protect or improve water quality or quantity; reduce wildfire risk; protect or enhance wildlife habitat, consistent with wildlife objectives established by the applicable state fish and wildlife agency; improve forest health, including addressing native, nonnative, and invasive pests; or enhance opportunities for new and existing markets in which the production and use of wood products strengthens local and regional economies. USDA shall establish a measurement system to measure the results of landscape-scale restoration projects assisted under this bill. USDA shall allocate from the amounts made available under this bill: 50% for the competitive process for distributing funds for landscape-scale restoration projects; and 50% proportionally to states to maximize the achievement of the restoration program's objectives and to address the highest national priorities, as identified in state-wide assessments and long-term state-wide forest resource strategies. It is unlawful to injure a coral reef or its ecosystem subject to certain exemptions. The bill modifies the goals and objectives of the national coral reef action strategy. NOAA must submit a report to Congress describing all activities undertaken to implement the strategy. Additionally, NOAA is authorized to: (1) make community-based planning grants for increased protection of high priority coral reefs, (2) maintain an inventory of all coral reef vessel groundings, (3) identify all coral reefs with a high incidence of vessel impacts, and (4) identify measures to reduce such impacts. NOAA must also submit an international coral reef ecosystem strategy to Congress and may establish an international coral reef ecosystem partnership program.The international strategy must be published in the Federal Register. The bill establishes the U.S. Coral Reef Task Force to coordinate federal actions that are designed to preserve and protect coral reef ecosystems. The bill prescribes requirements for disposition of the gross proceeds of the sales of lands under this bill, including that: 15% be paid to the state where the sale takes place to be used to supplement the education of students in kindergarten through grade 12, to supplement public support of institutions of public higher education, and to supplement state agricultural and natural resource agencies; and 10% of such proceeds be deposited in a special account to be created in the Treasury which may be used for the acquisition of recreational beneficial lands and interests (providing an opportunity for hunting, recreational fishing, recreational shooting, recreational off-highway vehicles, or other recreational purposes, or to achieve better management of public lands through consolidation of federal ownership). 2023-01-11T13:33:21Z

A "categorical exclusion" is an exception to the requirements of the National Environmental Policy Act of 1969 for a project or activity relating to the management of National Forest System lands or public lands that would otherwise be considered a major federal action. Beginning in FY2018, USDA shall identify the amount of funds, if any, appropriated in the previous fiscal year pursuant to the authorization of appropriations specified in this bill. Within five years of the end of the fiscal year in which an identification is made, USDA shall sell an amount of timber the sale of which is sufficient to recoup the identified amount and any associated costs. (Sec. 105) Objectives for coastal zone enhancement grants under CZMA are expanded to include interstate water resource and coastal management planning, policies to ensure sufficient state response to the environmental, economic, and social impacts of oil spills or other accidents, and maximizing the efficiency of processing permits for coastal zone activities. (Sec. 106) NOAA is required to evaluate the National Estuarine Research Reserve System periodically to determine if any of the protected areas in the estuarine reserves should be expanded. (Sec. 107) NOAA must submit to Congress a report summarizing any actions it takes in accordance with this bill for five consecutive fiscal years. TITLE II--GULF OF MEXICO REGIONAL COORDINATION (Sec.202) The purposes of this title are to: (1) expand and strengthen the cooperative voluntary efforts to conserve and restore the Gulf of Mexico; (2) recognize and enable the Gulf of Mexico Alliance as a coordinating entity; and (3) enable grant funding for coordination management, scientific research, conservation, and restoration activities.
