The bill prescribes general requirements for projects to reclaim abandoned mine lands and waters that are likely to create favorable conditions for the economic development of the project site or promote the general welfare through economic and community development of the area in which the project is conducted. Before conducting any Internet-based sale, BOEM is required to gather information from each company present for bidding at the 10 most recent oil and gas lease sales conducted under the Outer Continental Shelf Lands Act. The information is designed to provide the bidding public sufficient opportunity to share ideas, methods, and concerns regarding Internet-based leasing. All Internet-based sales must meet certain requirements and BOEM shall publicly disclose statistical data regarding any sale on the day the sale is executed. The bill prescribes the criteria for determining whether a proposed PSDAR is permissible if a host state files a statement of conditional support. The NRC must determine the adequacy or inadequacy of a proposed PSDAR and issue a decision document accordingly. The NRC must not approve a proposed PSDAR unless the proposed PSDAR requires compliance with applicable state law relating to air, water, soil quality, or radiological standards if the state law is more restrictive than its federal counterpart. DOE may enter into a memorandum of understanding with the Nuclear Regulatory Commission (NRC) to establish a National Nuclear Innovation Center that: enables the testing and demonstration of reactor concepts to be proposed and funded by the private sector, establishes and operates a database to store and share data and knowledge on nuclear science between federal agencies and private industry, and establishes capabilities to develop and test reactor electric and nonelectric integration and energy conversion systems. An eligible project shall include the participation of a partnership consisting of two or more entities that: (1) may include any institution of higher education, a National Laboratory, a representative of a state or local government, a representative of an Indian tribe, or a federal power marketing administration; and (2) shall include an investor-owned electric utility, a publicly owned utility, a technology provider, a rural electric cooperative, a regional transmission organization, or an independent system operator. Interior shall: (1) cancel any lease issued under such Act before the date of enactment of this Act in the Beaufort Sea, Cook Inlet, or Chukchi Sea; and (2) not conduct any lease sale, enter into any new lease, reoffer for lease any land covered by an expiring lease, or renew, reinstate, or extend any nonproducing lease in existence before such date for onshore fossil fuels, including coal, oil, tar sands, oil shale, and gas on land subject to the Mineral Leasing Act. The bill establishes: (1) a nonbinding goal to reduce greenhouse gas emissions 2% per year on average through 2025, and (2) a federal energy efficiency resource standard for retail electricity and natural gas suppliers. The bill repeals royalty relief for leases in the Outer Continental Shelf with respect to the production of oil or gas from deep water production or ultra deep wells in shallow waters. The Department of Interior must: (1) prevent venting and flaring of gases in oil and natural gas production operations on federal land, and (2) promote the capture of beneficial use or reinjection of gas in those operations. Interior must establish an annual production incentive fee with respect to public land that is subject to a lease for production of oil or natural gas under which production is not occurring. The bill prescribes requirements for: (1) concurrent federal and state application reviews, (2) issue identification and resolution, (3) failure to meet schedule, (4) remote environmental surveys, and (5) application processing that allows an applicant to fund third-party contractor to assist in reviewing the application. When an application requires multiple federal authorizations, FERC must track and publicize on its website the actions required to complete permitting, reviews, and other requisite actions. (Sec. 1102) The Federal Power Act (FPA) is amended to require FERC, in resolving environmental and grid reliability conflicts, to ensure that any emergency order which may result in conflict with federal, state, or local environmental law or regulations: requires electric energy generation, delivery, interchange, or transmission only during hours necessary to meet the emergency; is consistent with environmental law or regulation; and minimizes adverse environmental impacts. An order that does conflict with federal, state, or local environmental law must expire within 90 days after issuance, although FERC may renew it for subsequent 90-day periods.
