Rubio, Marco [R-FL] FL R R000595 6 Lifting Local Communities Act This bill specifies that government entities may not discriminate against religious organizations when awarding federal funds for social services programs (i.e., government programs that provide services for low-income individuals and communities, such as child care, transportation, employment, housing, and meal services). Specifically, religious organizations are eligible to apply for and receive federal funds to provide services for social services programs on the same basis as private, nonreligious organizations. Additionally, government entities may not discriminate against private organizations on the basis of religion when selecting funding recipients. Organizations that receive federal funds for social services programs may not discriminate against individuals on the basis of religion when providing services. If an individual objects to the character or affiliation of a private organization that is providing a service as part of a social services program, government entities must provide the individual with reasonable alternatives. Religious organizations may bring civil actions against entities for violations. 2024-07-24T15:24:04Z

(Sponsor introductory remarks on measure: CR S3806-3808) Senate Sen. Kaine, Tim [D-VA] VA D K000384 3 Reproductive Freedom for All Act This bill establishes a general right of all persons to make certain reproductive decisions without undue government interference. It specifically provides statutory authority for the Supreme Court's prior holdings in Roe v. Wade and Planned Parenthood of Southeastern Pennsylvania v. Casey. In Roe, the Court held that the Constitution protects a woman's decision to terminate her pregnancy. In Casey, the Court reaffirmed this holding and additionally held that state abortion regulations may not place a substantial obstacle in the path of a woman seeking an abortion before fetal viability (i.e., an undue burden). However, a state may (1) restrict abortions after viability, except when a pregnancy endangers the life or health of the woman; and (2) enact regulations to further the health or safety of a woman seeking an abortion, except for unnecessary health regulations that present a substantial obstacle to a woman seeking an abortion. Additionally, the bill provides statutory authority for the Court's holdings in Griswold v. Connecticut (the right of married couples to obtain contraception), Eisenstadt v. Baird (the right of single persons to obtain contraception), Carey v. Population Services International (the right of minors to obtain contraception), and Whole Woman's Health v. Hellerstedt (that certain state restrictions on abortion facilities and providers created an undue burden). The bill allows the Department of Justice or any person adversely affected by a state law that violates this bill to seek injunctive relief. It also specifies that the bill does not affect laws regarding conscience protection. 2023-06-08T19:45:25Z

(Sponsor introductory remarks on measure: CR S3380) Senate Sen. Feinstein, Dianne [D-CA] CA D F000062 43 Respect for Marriage Act This bill provides statutory authority for same-sex and interracial marriages. Specifically, the bill repeals and replaces provisions that define, for purposes of federal law, marriage as between a man and a woman and spouse as a person of the opposite sex with provisions that recognize any marriage that is valid under state law. (The Supreme Court held that the current provisions were unconstitutional in United States v. Windsor in 2013.) The bill also repeals and replaces provisions that do not require states to recognize same-sex marriages from other states with provisions that prohibit the denial of full faith and credit or any right or claim relating to out-of-state marriages on the basis of sex, gender, race, ethnicity, or national origin. (The Supreme Court held that state laws barring same-sex marriages were unconstitutional in Obergefell v. Hodges in 2015; the Court held that state laws barring interracial marriages were unconstitutional in Loving v. Virginia in 1967.) The bill allows the Department of Justice to bring a civil action and establishes a private right of action for violations. 2023-11-10T04:56:30Z

117-s-3415 117 s 3415 Constitutional Accountability Act Civil Rights and Liberties, Minority Issues 2021-12-16 2021-12-16 Read twice and referred to the Committee on the Judiciary. Senate Sen. Whitehouse, Sheldon [D-RI] RI D W000802 0 Constitutional Accountability Act This bill extends civil liability to federal, state, and local government entities and officials for constitutional violations committed by law enforcement officers. Current law provides a statutory civil cause of action against state and local government actors (e.g., law enforcement) for violations of constitutional rights (also known as Section 1983 lawsuits); the Supreme Court has also found an implied cause of action against federal law enforcement officers in certain situations (e.g., Fourth Amendment violations). However, under the judicial doctrine of qualified immunity, government officials performing discretionary duties are generally shielded from civil liability except when their actions violate clearly established rights of which a reasonable person would have known. Additionally, under the doctrine of sovereign immunity, federal and state government entities generally cannot be sued without their consent. Further, the Supreme Court has held that a local government entity cannot be sued for an injury inflicted by its employees. The bill provides a statutory civil cause of action against and extends liability to federal, state, and local government entities and officials for violations of constitutional rights committed by law enforcement officers in their employment, regardless of any immunity that would otherwise apply. 2022-12-30T03:34:00Z
117-s-3417 117 s 3417 Latonya Reeves Freedom Act of 2021 Civil Rights and Liberties, Minority Issues 2021-12-16 2021-12-16 Read twice and referred to the Committee on Health, Education, Labor, and Pensions. Senate Sen. Bennet, Michael F. [D-CO] CO D B001267 22 Latonya Reeves Freedom Act of 2021 This bill prohibits government entities and insurance providers from denying community-based services to individuals with disabilities that require long-term service or support that would enable such individuals to live in the community and lead an independent life. Specifically, these entities may not discriminate against such individuals in the provision of community-based services by such actions as imposing prohibited eligibility criteria, cost caps, or waiting lists or failing to provide a specific community-based service. Additionally, community-based services must be offered to individuals with such disabilities prior to institutionalization. Institutionalized individuals must be notified regularly of community-based alternatives. The bill requires the Department of Justice to issue regulations requiring government entities and insurance providers to offer community-based long-term services to individuals with such disabilities who would otherwise qualify for institutional placement. Government entities must ensure sufficient availability of affordable, accessible, and integrated housing that is not a disability-specific residential setting or a setting where services are tied to tenancy. Regulations shall also (1) require government entities and insurance providers to perform self-evaluation on current services, policies, and practices and concerning compliance with requirements of this bill; and (2) require government entities to submit a transition plan. The bill provides funds for FY2022 for the Department of Health and Human Services to provide technical assistance with respect to transition plans. The bill allows civil actions by individuals subjected to, or about to be subjected to, a violation of its requirements. 2022-12-30T03:34:00Z

Currently, individuals have a statutory right to bring such suits against state or local officials (e.g., law enforcement), commonly known as Section 1983 suits or Bivens actions. Although the statute does not explicitly authorize such suits against federal officials, the Supreme Court has found this right to be inferred from the Constitution in certain situations (e.g., Fourth Amendment violations committed by federal law enforcement officers). 2023-07-31T14:45:21Z

[D-NJ] NJ D B001288 35 Do No Harm Act This bill prohibits the application of the Religious Freedom Restoration Act of 1993 (RFRA) to specified federal laws or the implementation of such laws. Currently, RFRA prohibits the government from substantially burdening a person's exercise of religion even if the burden results from a rule of general applicability, except in furtherance of a compelling governmental interest when using the least restrictive means. Under the bill, RFRA is inapplicable to laws or the implementation of laws that protect against discrimination or the promotion of equal opportunity (e.g., the Civil Rights Act of 1964); require employers to provide wages, other compensation, or benefits, including leave; protect collective activity in the workplace; protect against child labor, abuse, or exploitation; or provide for access to, information about, referrals for, provision of, or coverage for, any health care item or service. The bill prevents RFRA from being used to deny (1) goods or services the government has contracted, granted, or made an agreement to provide to a beneficiary of or participant in a program or activity funded by such government contract, grant, agreement, or other award; or (2) a person's full and equal enjoyment of a government-provided good, service, benefit, facility, privilege, advantage, or accommodation. In order for a person to assert a RFRA claim or defense in a judicial proceeding, the government must be a party to the proceeding. 2022-12-31T05:35:23Z

Senate Sen. Rubio, Marco [R-FL] FL R R000595 2 Protecting Students From Racial Hostility Act This bill prohibits school curriculums or teachings that promote certain concepts based on race. Specifically, the bill prohibits schools from promoting concepts that result in a racially hostile environment, which the bill defines as an environment in which (1) racial discrimination has created an adverse setting, (2) an individual is fearful due to a racially intimidating or offensive environment, or (3) an individual is restricted from participating in or benefiting from a program or activity on the basis of race. Prohibited concepts include the idea that (1) one race is inherently superior to another, (2) the United States is fundamentally racist, and (3) an individual bears responsibility for the past actions of others of the same race. The bill makes the use of such curriculums or teachings a violation of Title VI of the Civil Rights Act of 1964, which prohibits discrimination based on race, color, or national origin in federally funded programs or activities. Any intimidation, threat, or other interference with respect to an individual's rights or participation in related proceedings (e.g., the ability to file complaints about the use of prohibited curriculums) shall also be considered a violation of Title VI. The bill applies to elementary and secondary schools and to colleges and universities. 2023-06-13T13:31:11Z

Senate Sen. Blumenthal, Richard [D-CT] CT D B001277 3 Economic Inclusion Civil Rights Act of 2021 This bill modifies the prohibition against intentional racial discrimination in the context of economic activity such as employment, contracts, or other commercial transactions. Specifically, the bill makes an action that has a discriminatory effect a violation of section 1977 of the Revised Statutes. It also states that all non-White persons within U.S. jurisdiction shall have the same right in every state and territory as is enjoyed by White citizens in certain respects. No person shall use a criterion, method of administration, practice, or policy that has a disparate impact in violation of that provision. Further, a plaintiff may prove intentional discrimination by showing only that the discriminatory intent was a motivating factor in the alleged violation. Under current law, a plaintiff must prove that the harm would not have occurred but for the defendant's unlawful conduct. Additionally, standing shall not be limited to victims who were parties to, or third-party beneficiaries of, a contract with the defendant. The bill provides for a right to jury trial and no joint-action waiver or pre-dispute arbitration agreement shall be enforceable with respect to any alleged violation. The bill provides for a four-year statute of limitations. 2022-12-31T05:25:50Z
