Boxer, Barbara [D-CA-6] | CA | D | B000711 | 182 | Dolphin Protection and Consumer Information Act of 1990 - Requires the label of any tuna product exported from or offered for sale in the United States which contains tuna harvested with driftnets or in the eastern tropical Pacific Ocean with purse seine nets to bear the statement, "THE TUNA IN THIS PRODUCT WAS CAUGHT WITH METHODS THAT KILL DOLPHINS." Declares as dolphin safe products from tuna harvested by vessels using purse seine nets if certain written statements are made by the vessel captain and others that the nets were not deployed on or to encircle dolphins. Sets forth civil penalties for producing, advertising, selling, importing to, or exporting from the United States a tuna product that does not include such a statement. Imposes civil and criminal penalties for knowing and willful mislabeling. Allows any person to commence a civil suit against any person, including the United States or other governmental agency, to enforce this Act. Gives U.S. district courts jurisdiction, without regard to the amount in controversy or the citizenship of the parties, over actions under this Act. Amends the Marine Mammal Protection Act of 1972 to require that the government of a nation exporting fish or fish products to the United States to provide evidence that the fish was not harvested with a driftnet in the South Pacific Ocean after July 1, 1991, or in any other waters of the high seas after July 1, 1992. Directs the Secretary of State to seek, through negotiations with foreign governments, to reduce and eliminate the harvesting of tuna through the use of purse seine nets intentionally deployed to encircle dolphins. Prohibits, until successful conclusion of the negotiations, the sale of any tuna product in the United States unless the Secretary certifies that it was harvested in a dolphin safe manner. Authorizes appropriations to the Secretary of Commerce and to the Commissioner of the Food and Drug Administration to carry out this Act. | 2024-02-05T14:30:09Z |
