Powell of Middleboro, MA (petitioner) in a January, 2013 letter to the Administrator of NHTSA (the "Agency"). The petitioner requested that the Agency open an investigation into software and brake failures on model year (MY) 2012 Toyota Prius C vehicles (the "Subject Vehicles"). After reviewing materials in-hand, those furnished by the petitioner, and upon completing an inspection of her vehicle, NHTSA sees no indication that additional investigation would lead to a finding that a defect related to motor vehicle safety exists. NHTSA has concluded that further investigation of the issue raised in the petition is not warranted.
