The term includes those employees of the DOE assisting in the conduct of trial-type hearings by performing functions on behalf of the Assistant Secretary or presiding official.\n\n(d)  DOE  means the Department of Energy, of which FE is a part.\n\n(e)  DOE Act  means the Department of Energy Organization Act, Public Law 95-91, 91 Stat. 565 (42 U.S.C. 7101  et seq. ).\n\n(f)  FE  means the Office of The Assistant Secretary for Fossil Energy.\n\n(g)  FERC  means the Federal Energy Regulatory Commission.\n\n(h)  Interested person  means a person, other than a decisional employee, whose interest in a proceeding goes beyond the general interest of the public as a whole and includes applicants, intervenors, competitors of applicants, and other individuals and organizations, including non-profit and public interest organizations, and state, local, and other public officials, with a proprietary, financial or other special interest in the outcome of a proceeding. The term does not include other federal agencies or foreign governments and their representatives, unless the agency, foreign government, or representative of a foreign government is a party to the proceeding.\n\n(i)  Natural gas  means natural gas and mixtures of natural gas and synthetic natural gas, regardless of physical form or phase, including liquefied natural gas and gels primarily composed of natural gas.\n\n(j)  NGA  means the Natural Gas Act of June 21, 1938, c. 556, 52 Stat. 821 (15 U.S.C. 717  et seq. ).\n\n(k)  Off-the-record communication  means a written or oral communication not on the record which is relevant to the merits of a proceeding, and about which the parties have not been given reasonable prior notice of the nature and purpose of the communication and an opportunity to be present during such communication or, in the case of a written communication, an opportunity to respond to the communication. It does not include communications concerned solely with procedures which are not relevant to the merits of a proceeding. It also does not include general background discussions about an entire industry or natural gas markets or communications of a general nature made in the course of developing agency policy for future general application, even though these discussions may relate to the merits of a particular proceeding.\n\n(l)  Party  means an applicant, any person who has filed a motion for and been granted intervenor status or whose motion to intervene is pending, and any state commission which has intervened by notice pursuant to \u00a7 590.303(a).\n\n(m)  Person  means any individual, firm, estate, trust, partnership, association, company, joint-venture, corporation, United States local, state and federal governmental unit or instrumentality thereof, charitable, educational or other institution, and others, including any officer, director, owner, employee, or duly authorized representative of any of the foregoing.\n\n(n)  Presiding official  means any employee of the DOE who has been designated by the Assistant Secretary to conduct any stage of a proceeding, which may include presiding at a conference, oral presentation, or trial-type hearing, and who has been delegated the authority of the Assistant Secretary to make rulings and issue orders in the conduct of such proceeding, other than final opinions and orders, orders to show cause, emergency interim orders, or conditional decisions under subpart D and orders on rehearing under subpart E.\n\n(o)  Proceeding  means the process and activity, and any part thereof, instituted by FE either in response to an application, petition, motion or other filing under this part, or on its own initiative, by which FE develops and considers the relevant facts, policy and applicable law concerning the importation or exportation of natural gas and which may lead to the issuance of an order by the Assistant Secretary under subparts D and E.\n\n(p)  Small-scale natural gas export  means an export of natural gas to nations with which there is not in effect a free trade agreement with the United States requiring national treatment for trade in natural gas and with which trade is not prohibited by U.S. law or policy, provided that the application for such export authority satisfies the following two criteria:\n\n(1) The application proposes to export natural gas in a volume up to and including 51.75 billion cubic feet per year, and\n\n(2) DOE's approval of the application does not require an environmental impact statement or an environmental assessment under the National Environmental Policy Act, 42 U.S.C. 4321  et seq.\n\n(q)  State commission  means the regulatory body of a state or municipality having jurisdiction to regulate rates and charges for the sale of natural gas to consumers within the state or municipality, or having any regulatory jurisdiction over parties involved in the import or export arrangement."], ["10:10:5.0.1.2.8.1.1.4", 10, "Energy", "II", "G", "590", "PART 590\u2014ADMINISTRATIVE PROCEDURES WITH RESPECT TO THE IMPORT AND EXPORT OF NATURAL GAS", "A", "Subpart A\u2014General Provisions", "", "\u00a7 590.103 General requirements for filing documents with FE.", "DOE", "", "", "[54 FR 53531, Dec. 29, 1989, as amended at 90 FR 20761, May 16, 2025]", "(a) Any document, including but not limited to an application, amendment of an application, request, petition, motion, answer, comment, protest, complaint, and any exhibit submitted in connection with such documents, shall be filed with FE in accordance with the instructions at FE's website:  https://www.energy.gov/fe/regulation .\n\n(b) Upon receipt by FE, each application or other initial request for action shall be assigned a docket number. All factual matters shall be supported to the extent practicable by the necessary data or documents. Copies of relevant documents filed or intended to be filed with FERC may be submitted to satisfy the requirements of this section. Topics to be addressed or described shall include:\n\n(1) The scope of the project, including the volumes of natural gas involved, expressed in either Mcf or Bcf and their Btu equivalents, the dates of commencement and completion of the proposed import or export, and the facilities to be utilized or constructed;\n\n(2) The source and security of the natural gas supply to be imported or exported, including contract volumes and a description of the gas reserves supporting the project during the term of the requested authorization;\n\n(3) Identification of all the participants in the transaction, including the parent company, if any, and identification of any corporate or other affiliations among the participants;\n\n(4) The terms of the transaction, such as take-or-pay obligations, make-up provisions, and other terms that affect the marketability of the gas;\n\n(5) The provisions of the import arrangement which establish the base price, volume requirements, transportation and other costs, and allow adjustments during the life of the project, and a demonstration as to why the import arrangement is and will remain competitive over the life of the project and is otherwise not inconsistent with the public interest;\n\n(6) For proposed imports, the need for the natural gas by the applicant or applicant's prospective customers, including a description of the persons who are expected to purchase the natural gas; and for proposed exports, the lack of a national or regional need for the gas; and\n\n(7) The potential environmental impact of the project. To the extent possible, the application shall include a listing and description of any environmental assessments or studies being performed on the proposed gas project. The application shall be updated as the status of any environmental assessments changes.\n\n(c) The application shall also have attached a statement, including a signed opinion of legal counsel, showing that a proposed import or export of natural gas is within the corporate powers of the applicant and a copy of all relevant contracts and purchase agreements.\n\n(d) The Assistant Secretary or the Assistant Secretary's delegate may at any time require the applicant and other parties to make supplemental filings of additional information necessary to resolve issues raised by the application.\n\n(e) All information and data filed in support of or against an application will be placed in the official FE docket file of the proceeding and will not be afforded confidential treatment, unless the party shows why the information or data should be exempted from public disclosure and the Assistant Secretary or Assistant Secretary's delegate determines that such information or data shall be afforded confidential treatment. The notice may also request comments on specific issues or matters of fact, law, or policy raised by the application.\n\n(b) The notice of application shall advise the parties of their right to request additional procedures, including the opportunity to file written comments and to request that a conference, oral presentation, or trial-type hearing be convened. Failure to request additional procedures at this time shall be deemed a waiver of any right to additional procedures should the Assistant Secretary decide to grant the application and authorize the import or export by issuing a final opinion and order in accordance with \u00a7 590.316.\n\n(c) Where negotiations between the DOE, including FE, and a foreign government have resulted in a formal policy agreement or statement affecting a particular import or export proceeding, FE shall include in the notice of application a description of the terms or policy positions of that agreement or statement to the extent they apply to the proceeding, and invite comment. L. 91-597, 84 Stat. 1620  et seq. ).\n\nAdministrator  means the Administrator of the Food Safety and Inspection Service or any officer or employee of the Department of Agriculture to whom authority has been delegated or may be delegated to act in his or her stead.\n\nAdulterated  means any egg or egg product under one or more of the following circumstances:\n\n(a) If it bears or contains any poisonous or deleterious substance which may render it injurious to health; but in case the substance is not an added substance, such article shall not be considered adulterated under this clause if the quantity of such substance in or on such article does not ordinarily render it injurious to health;\n\n(b)(1) If it bears or contains any added poisonous or added deleterious substance (other than one which is (i) a pesticide chemical in or on a raw agricultural commodity; (ii) a food additive; or (iii) a color additive) which may in the judgment of the Secretary, make such article unfit for human food;\n\n(2) If it is, in whole or in part, a raw agricultural commodity and such commodity bears or contains a pesticide chemical which is unsafe within the meaning of section 408 of the Federal Food, Drug, and Cosmetic Act;\n\n(3) If it bears or contains any food additive which is unsafe within the meaning of section 409 of the Federal Food, Drug, and Cosmetic Act;\n\n(4) If it bears or contains any color additive which is unsafe within the meaning of section 706 of the Federal Food, Drug, and Cosmetic Act: Provided, that an article which is not otherwise deemed adulterated under paragraph (b)(2), (3), or (4) of this definition shall nevertheless be deemed adulterated if use of the pesticide chemical, food additive, or color additive, in or on such article, is prohibited by regulations of the Secretary in official plants;\n\n(c) If it consists in whole or in part of any filthy, putrid, or decomposed substance, or if it is otherwise unfit for human food;\n\n(d) If it has been prepared, packaged, or held under insanitary conditions whereby it may have become contaminated with filth, or whereby it may have been rendered injurious to health;\n\n(e) If it is an egg which has been subjected to incubation or the product of any egg which has been subjected to incubation;\n\n(f) If its container is composed, in whole or in part of any poisonous or deleterious substance which may render the contents injurious to health;\n\n(g) If it has been intentionally subjected to radiation, unless the use of the radiation was in conformity with a regulation or exemption in effect pursuant to section 409 of the Federal Food, Drug, and Cosmetic Act; or\n\n(h) If any valuable constituent has been, in whole or in part, omitted or abstracted therefrom; or if any substance has been substituted, wholly or in part therefor; or if damage or inferiority has been concealed in any manner; or if any substance has been added thereto or mixed or packed therewith so as to increase its bulk or weight, or reduce its quality or strength, or make it appear better or of greater value than it is.\n\nAmbient temperature  means the air temperature maintained in an egg storage facility or transport vehicle.\n\nApplicant  means any person who requests any inspection service as authorized under the Act or the regulations of this part.\n\nCapable of use as human food  means any egg or egg product, unless it is denatured, or otherwise identified, as required by these regulations to deter its use as human food.\n\nClass  means any subdivision of a product based on essential physical characteristics that differentiate between major groups of the same kind, type, or method of processing.\n\nCommerce  means interstate, foreign, or intrastate commerce.\n\nCondition  means any condition (including, but not being limited to, the state of preservation, cleanliness, soundness, wholesomeness, or fitness for human food) of any product which affects its merchantability; or any condition, including but not being limited to, the processing, handling, or packaging which affects such product.\n\nContainer  or  Package  includes for egg products, any box, can, tin, plastic, or other receptacle, wrapper, or cover and for shell eggs, any carton, basket, case, cart, pallet, or other receptacle.\n\n(a)  Immediate container  means any package or other container in which egg products or shell eggs are packed for household or other ultimate consumers.\n\n(b)  Shipping container  means any container used in packing an immediate container.\n\nDepartment  means the U.S. Department of Agriculture.\n\nEgg  means the shell egg of the domesticated chicken, turkey, duck, goose, or guinea. Some of the terms applicable to shell eggs are as follows:\n\n(a)  Check  means an egg that has a broken shell or crack in the shell but has its shell membranes intact and contents not leaking.\n\n(b)  Clean and sound shell egg  means any egg whose shell is free of adhering dirt or foreign material and is not cracked or broken.\n\n(c)  Dirty egg  or  Dirt  means an egg that has a shell that is unbroken and has adhering dirt or foreign material.\n\n(d)  Incubator reject  means an egg that has been subjected to incubation and has been removed from incubation during the hatching operations as infertile or otherwise unhatchable.\n\n(e)  Inedible  means eggs of the following descriptions: Black rots, yellow rots, white rots, mixed rots, sour eggs, eggs with green whites, eggs with stuck yolks, moldy eggs, musty eggs, eggs showing blood rings, and eggs containing embryo chicks (at or beyond the blood ring stage).\n\n(f)  Leaker  means an egg that has a crack or break in the shell and shell membranes to the extent that the egg contents are exposed or are exuding or free to exude through the shell.\n\n(g)  Loss  means an egg that is unfit for human food because it is smashed or broken so that its contents are leaking; or overheated, frozen, or contaminated; or an incubator reject; or because it contains a bloody white, large meat spots, a large quantity of blood, or other foreign material.\n\n(h)  Restricted egg  means any check, dirty egg, incubator reject, inedible, leaker, or loss.\n\nEgg handler  means any person, excluding the ultimate consumer, who engages in any business in commerce that involves buying or selling any eggs (as a poultry producer or otherwise), or processing any egg products, or otherwise using any eggs in the preparation of human food.\n\nEgg product  means any dried, frozen, or liquid eggs, with or without added ingredients, excepting products which contain eggs only in a relatively small proportion or historically have not been, in the judgment of the Secretary, considered by consumers as products of the egg food industry, and which may be exempted by the Secretary under such conditions as the Secretary may prescribe to assure that the egg ingredients are not adulterated and such products are not represented as egg products. For the purposes of this part, the following products, among others, are exempted as not being egg products: Cooked egg products, imitation egg products, dietary foods, dried no-bake custard mixes, egg nog mixes, acidic dressings, noodles, milk and egg dip, cake mixes, French toast, and sandwiches containing eggs or egg products, provided such products are prepared from inspected egg products or eggs containing no more restricted eggs than are allowed in the official standards for U.S. Consumer Grade B shell eggs. Balut and other similar ethnic delicacies are also exempted from inspection under this part.\n\nEggs of current production  means shell eggs which have moved through the usual marketing channels since the time they were laid and are not in excess of 60 days old.\n\nFair Packaging and Labeling Act  means the Act so entitled, approved November 3, 1966 (80 Stat. 1296), and Acts amendatory thereof or supplementary thereto.\n\nFederal Food, Drug, and Cosmetic Act  means the Act so entitled, approved June 25, 1938 (52 Stat. 1040), and Acts amendatory thereof or supplementary thereto.\n\nInspection  means the application of such inspection methods and techniques as are deemed necessary by the responsible Secretary to carry out the provisions of the Egg Products Inspection Act and the regulations under this part.\n\nInspection program personnel  means any inspector or other individual employed by the Department or any cooperating agency who is authorized by the Secretary to do any work or perform any duty in connection with the Program.\n\nInspection service  means the official service within the Department having the responsibility for carrying out the provisions of the Egg Products Inspection Act. Inspection service also means the activities performed, including official reporting by such official service.\n\nInterested party  means any person financially interested in a transaction involving any inspection or appeal inspection of any product, or the decision of an inspector.\n\nLabel  means a display of any printed, graphic, or other method of identification upon the shipping container, if any, or upon the immediate container, including but not limited to, an individual consumer package of eggs and egg products, or accompanying such product.\n\nMisbranded  means any egg products which are not labeled and packaged in accordance with the requirements prescribed by regulations of the Administrator under this part.\n\nNest-run eggs  means eggs which are packed as they come from the production facilities without having been washed, sized and/or candled for quality, with the exception that some checks, dirties, or other obvious undergrades may have been removed.\n\nOfficial certificate  means any certificate prescribed by regulations of the Administrator for issuance by an inspector or other person performing official functions under this part.\n\nOfficial device  means any device prescribed or authorized by the Secretary for use in applying any official mark.\n\nOfficial identification  means the official inspection mark or any other symbol prescribed by regulations of this part to identify the status of any article.\n\nOfficial inspection mark  means any symbol prescribed by the regulations of the Administrator showing that egg products were inspected in accordance with this part.\n\nOfficial plant  means any plant in which the plant facilities, methods of operation, and sanitary procedures have been found suitable and adequate by the Administrator for the inspection of egg products pursuant to the regulations in this part and in which inspection service is carried on.\n\nOfficial standards  means the standards of quality, grades, and weight classes for eggs.\n\nOffice of inspection  means the office of any inspector.\n\nPasteurize  means the subjecting of each particle of egg products to heat or other treatments to destroy harmful viable microorganisms.\n\nPerson  means any individual, partnership, corporation, association, or other business unit.\n\nPesticide chemical, Food additive, Color additive,  and  Raw agricultural commodity  shall have the same meaning for purposes of this part as under the Federal Food, Drug, and Cosmetic Act.\n\nPotable water  means water that has been approved by a State health authority or other agency or laboratory acceptable to the Administrator as safe for drinking and suitable for food processing.\n\nProcessing  means manufacturing of egg products, including breaking eggs or filtering, mixing, blending, pasteurizing, stabilizing, cooling, freezing or drying, or packaging or repackaging egg products at official plants.\n\nProducer-packer  means any producer who sorts eggs only from his own production and packs them into their various qualities.\n\nQuality  means the inherent properties of any product which determine its relative degree of excellence.\n\nRegulations  means the provisions in this part.\n\nRegulatory inspector  means any employee of the U.S. Government, or State or local jurisdiction, who is authorized by the Secretary to make such inspections as required in \u00a7 590.28 of these regulations.\n\nSampling  means the act of taking samples of any product for inspection or analyses.\n\nSecretary  means the Secretary of Agriculture or his delegate.\n\nShell egg packer  means any person engaged in the sorting of shell eggs from sources other than or in addition to the person's own production into their various qualities, either mechanically or by other means.\n\nShipped for retail sale  means eggs that are forwarded from the processing facility for distribution to the ultimate consumer.\n\nStabilization  means the subjection of any egg product to a desugaring process.\n\nState  means any State of the United States, the Commonwealth of Puerto Rico, the Virgin Islands of the United States, and the District of Columbia.\n\nUltimate consumer  means any household consumer, restaurant, institution, or any other party who has purchased or received shell eggs or egg products for consumption.\n\nUnited States  means the States.\n\nWashed ungraded eggs  means eggs which have been washed but not sized or segregated for quality.\n\nWhite or albumen  means, for the purpose of this part, the product obtained from the egg as broken from the shell and separated from the yolk."], ["9:9:2.0.2.7.69.1.63.3", 9, "Animals and Animal Products", "III", "I", "590", "PART 590\u2014INSPECTION OF EGGS AND EGG PRODUCTS (EGG PRODUCTS INSPECTION ACT)", "A", "Subpart A\u2014General", "", "\u00a7 590.10 Authority.", "FSIS", "", "", "[42 FR 2971, Jan. 14, 1977. However, the formula submitted must include the percentage of ingredients in both liquid and dried form. If the product is comprised of two or more ingredients, such ingredients must be listed in the order of descending proportions by weight in the form in which the product is to be marketed (sold), except that ingredients in dried product (other than dry blended) may be listed in either liquid or dried form. When water (excluding that used to reconstitute dehydrated ingredients back to their normal composition) is added to a liquid or frozen egg product or to an ingredient of such products (in excess of the normal water content of that ingredient), the total amount of water added, including the water content of any cellulose or vegetable gums used, must be expressed as a percentage of the total product weight in the ingredient statement on the label;\n\n(2) The name, address and zip code of the distributor; qualified by such terms as \u201cdistributed by,\u201d or \u201cdistributors\u201d;\n\n(3) The lot number or an alternative code indicating the date of production, in accordance with \u00a7 590.200(a);\n\n(4) The net contents;\n\n(5) An official inspection symbol and the number of the official plant in which the product was processed under inspection as set forth in \u00a7 590.413;\n\n(6) Egg products processed from edible eggs of turkeys, ducks, geese, or guineas must be clearly and distinctly labeled with the common or usual name of the product and indicating the type of eggs or egg products used in the product, e.g., \u201cFrozen whole turkey eggs,\u201d \u201cFrozen whole chicken and turkey eggs.\u201d Egg products labeled without qualifying words as to the type of egg used in the product must be produced only from the edible egg of the domesticated chicken.\n\n(7) Egg products which are produced in an official plant from edible shell eggs of other than current production or from other egg products of shell eggs of other than current product must be clearly and distinctly labeled in close proximity to the common or usual name of the product, e.g., Manufactured from eggs of other than current production.\u201d\n\n(d) Liquid or frozen egg products identified as whole eggs and processed in other than natural proportions as broken from the shell must have a total egg solids content of 24.20 percent or greater.\n\n(e) Nutrition information may be included on labels used to identify egg products, providing such labeling complies with the provisions of 21 CFR part 101, promulgated under the Federal Food, Drug, and Cosmetic Act and the Fair Packaging and Labeling Act. Since these regulations have different requirements for consumer-packaged products than for bulk packaged egg products not for sale or distribution to household consumers, label submission must be accompanied with information indicating whether the label covers consumer packaged or bulk packaged products. Nutrition labeling is required when nutrients, such as proteins, vitamins, and minerals are added to the product, or when a nutritional claim or information is presented on the labeling, except for the following, which are exempt from nutrition labeling requirements:\n\n(1) Egg products shipped in bulk form for use solely in the manufacture of other food and not for distribution to household consumers in such bulk form or containers.\n\n(2) Products containing an added vitamin, mineral, or protein, or for which a nutritional claim is made on the label, or in advertising, which is supplied for institutional food use only, provided that the manufacturer or distributor provides the required nutrition information directly to those institutions.\n\n(3) Any nutrients included in the product solely for technological purposes may be declared solely in the ingredients statement, without complying with nutrition labeling, if the nutrient(s) is otherwise not referred to in labeling or in advertising. All labels showing nutrition information or claims are subject to review by the Food and Drug Administration prior to approval by the Department.\n\n(f)(1) No label, container, or packaging material may contain any statement that is false or misleading. If the Administrator has reason to believe that a statement or formulation shows that an egg product is adulterated or misbranded, or that any labeling, including the size or form of any container in use or proposed for use, with respect to eggs or egg products, is false or misleading in any way, the Administrator may direct that such use be withdrawn unless the labeling or container is modified
