All institutions provide a drug abuse education course to:\n\n(1) Inform inmates of the consequences of drug/alcohol abuse and addiction; and\n\n(2) Motivate inmates needing drug abuse treatment to apply for further drug abuse treatment, both while incarcerated and after release.\n\n(b)  Course placement.  (1) Inmates will get primary consideration for course placement if they were sentenced or returned to custody as a violator after September 30, 1991, when unit and/or drug abuse treatment staff determine, through interviews and file review that:\n\n(i) There is evidence that alcohol or other drug use contributed to the commission of the offense;\n\n(ii) Alcohol or other drug use was a reason for violation either of supervised release (including parole) or Bureau community status;\n\n(iii) There was a recommendation (or evaluation) for drug programming during incarceration by the sentencing judge; or\n\n(iv) There is evidence of a history of alcohol or other drug use.\n\n(2) Inmates may also be considered for course placement if they request to participate in the drug abuse education program but do not meet the criteria of paragraph (b)(1) of this section.\n\n(3) Inmates may not be considered for course placement if they:\n\n(i) Do not have enough time remaining to serve to complete the course; or\n\n(ii) Volunteer for, enter or otherwise complete a RDAP.\n\n(c)  Consent.  Inmates will only be admitted to the drug abuse education course if they agree to comply with all Bureau requirements for the program.\n\n(d)  Completion.  To complete the drug abuse education course, inmates must attend and participate during course sessions and pass a final course exam. Inmates will ordinarily have at least three chances to pass the final course exam before they lose privileges or the effects of non-participation occur (see paragraph (e) of this section).\n\n(e)  Effects of non-participation. To successfully complete the RDAP, inmates must complete each of the following components:\n\n(1)  Unit-based component.  Inmates must complete a course of activities provided by the Psychology Services Department in a treatment unit set apart from the general prison population. This component must last at least six months.\n\n(2)  Follow-up services.  If time allows between completion of the unit-based component of the RDAP and transfer to a community-based program, inmates must participate in the follow-up services to the unit-based component of the RDAP.\n\n(3)  Community Treatment Services (CTS).  Inmates who have completed the unit-based program and (when appropriate) the follow-up treatment and transferred to a community-based program must complete CTS to have successfully completed RDAP and receive incentives. The Warden, on the basis of his or her discretion, may find an inmate ineligible for participation in a community-based program; therefore, the inmate cannot complete RDAP.\n\n(b)  Admission criteria.  Inmates must meet all of the following criteria to be admitted into RDAP.\n\n(1) Inmates must have a verifiable substance use disorder.\n\n(2) Inmates must sign an agreement acknowledging program responsibility.\n\n(3) When beginning the program, the inmate must be able to complete all three components described in paragraph (a) of this section.\n\n(c)  Application to RDAP.  Inmates may apply for the RDAP by submitting requests to a staff member (ordinarily, a member of the unit team or the Drug Abuse Program Coordinator).\n\n(d)  Referral to RDAP.  Inmates will be identified for referral and evaluation for RDAP by unit or drug treatment staff.\n\n(e)  Placement in RDAP.  The Drug Abuse Program Coordinator decides whether to place inmates in RDAP based on the criteria set forth in paragraph (b) of this section.\n\n(f)  Completing the unit-based component of RDAP.  To complete the unit-based component of RDAP, inmates must have satisfactory attendance and participation in all RDAP activities.\n\n(g)  Expulsion from RDAP.  (1) Inmates may be removed from the program by the Drug Abuse Program Coordinator because of disruptive behavior related to the program or unsatisfactory progress in treatment.\n\n(2) Ordinarily, inmates must be given at least one formal warning before removal from RDAP. A formal warning is not necessary when the documented lack of compliance with program standards is of such magnitude that an inmate's continued presence would create an immediate and ongoing problem for staff and other inmates.\n\n(3) We may return an inmate who withdraws or is removed from RDAP to his/her prior institution (if we had transferred the inmate specifically to participate in RDAP).\n\n(h)  Effects of non-participation.  (1) If inmates refuse to participate in RDAP, withdraw, or are otherwise removed, they are not eligible for:\n\n(i) A furlough (other than possibly an emergency furlough);\n\n(ii) Performance pay above maintenance pay level, bonus pay, or vacation pay; and/or\n\n(iii) A Federal Prison Industries work program assignment (unless the Warden makes an exception on the basis of work program labor needs).\n\n(2) Refusal, withdrawal, and/or expulsion will be a factor to consider in determining length of community confinement.\n\n(3) Where applicable, staff will notify the United States Parole Commission of inmates' needs for treatment and any failure to participate in the RDAP."], ["28:28:2.0.3.3.22.6.127.5", 28, "Judicial Administration", "V", "C", "550", "PART 550\u2014DRUG PROGRAMS", "F", "Subpart F\u2014Drug Abuse Treatment Program", "", "\u00a7 550.54 Incentives for RDAP participation.", "BOP", "", "", "", "(a) An inmate may receive incentives for his or her satisfactory participation in the RDAP. Bureau-authorized institutions may also offer enhanced incentives as described in paragraph (a)(2) of this section.\n\n(1)  Basic incentives.  (i) Limited financial awards, based upon the inmate's achievement/completion of program phases.\n\n(ii) Consideration for the maximum period of time in a community-based treatment program, if the inmate is otherwise eligible.\n\n(iii) Local institution incentives such as preferred living quarters or special recognition privileges.\n\n(iv) Early release, if eligible under \u00a7 550.55.\n\n(2)  Enhanced incentives. Inmates may be eligible for early release by a period not to exceed twelve months if they:\n\n(1) Were sentenced to a term of imprisonment under either:\n\n(i) 18 U.S.C. Chapter 227, Subchapter D for a nonviolent offense; or\n\n(ii) D.C. Code \u00a7 24-403.01 for a nonviolent offense, meaning an offense other than those included within the definition of \u201ccrime of violence\u201d in D.C. Code \u00a7 23-1331(4); and\n\n(2) Successfully complete a RDAP, as described in \u00a7 550.53, during their current commitment.\n\n(b)  Inmates not eligible for early release.  As an exercise of the Director's discretion, the following categories of inmates are not eligible for early release:\n\n(1) Immigration and Customs Enforcement detainees;\n\n(2) Pretrial inmates;\n\n(3) Contractual boarders (for example, State or military inmates);\n\n(4) Inmates who have a prior felony or misdemeanor conviction within the ten years prior to the date of sentencing for their current commitment for:\n\n(i) Homicide (including deaths caused by recklessness, but not including deaths caused by negligence or justifiable homicide);\n\n(ii) Forcible rape;\n\n(iii) Robbery;\n\n(iv) Aggravated assault;\n\n(v) Arson;\n\n(vi) Kidnaping; or\n\n(vii) An offense that by its nature or conduct involves sexual abuse offenses committed upon minors;\n\n(5) Inmates who have a current felony conviction for:\n\n(i) An offense that has as an element, the actual, attempted, or threatened use of physical force against the person or property of another;\n\n(ii) An offense that involved the carrying, possession, or use of a firearm or other dangerous weapon or explosives (including any explosive material or explosive device);\n\n(iii) An offense that, by its nature or conduct, presents a serious potential risk of physical force against the person or property of another; or\n\n(iv) An offense that, by its nature or conduct, involves sexual abuse offenses committed upon minors;\n\n(6) Inmates who have been convicted of an attempt, conspiracy, or solicitation to commit an underlying offense listed in paragraph (b)(4) and/or (b)(5) of this section; or\n\n(7) Inmates who previously received an early release under 18 U.S.C. 3621(e).\n\n(c)  Early release time-frame. REE Agencies provide partial funding to cooperators to support research projects that contribute to REE program objectives and help carry out the REE mission. The project must consist of a project plan and/or statement of work, and a budget as follows:\n\n(1)  Project plan.  A  project plan  must be jointly developed by the Agency PI and the cooperator, and be compliant with a REE program requirement. The REE Agency may include program-specific requirements, as applicable. These requirements should be aligned with Agency strategic goals, strategic objectives, or performance goals that are relevant to the program.\n\n(2)  Statement of work.  A detailed  statement of work  must be jointly planned, developed, and prepared by the cooperator's PI and the Agency PI to address the objective(s), approach, statement of mutual interest, performance responsibilities (which may include specific performance goals, indicators, milestones, or expected outcomes, such as outputs, or services performed or public impacts of any of these, with an expected timeline for accomplishment), and any mutual agreements.\n\n(3)  Budget.  The  budget  is a funding plan that must be jointly developed by the Agency PI and the Cooperator PI. The approved budget must identify the cooperator resource contributions, both direct and indirect, by budget line item. The cooperator must provide a budget justification/narrative.\n\n(b)  Resource contributions.  Each party must contribute resources towards the successful completion of the non-assistance cooperative agreement.\n\n(1)  Agency resource contributions.  The  Agency's contribution  is the Federal share as reflected in the award.\n\n(2)  Cooperator resource contributions.  The  Cooperator's contribution  may consist of funds, services, or in-kind contributions, must be no less than 20 percent of the total funding provided by the REE Agency, and cannot fall below 20 percent of the total Federal funding throughout the period of performance. All cooperator contributions must consist of a sufficient amount of itemized direct costs to demonstrate a true stake in the project, as determined by the ADO. All contributions must be documented in the budget and be consistent with the cooperator's institution classification of costs.\n\n(i) Cooperator resource contributions must meet all of the following criteria:\n\n(A) Are verifiable from the Cooperator's records;\n\n(B) Are not included as contributions for any other Federal award;\n\n(C) Are necessary and reasonable for accomplishment of project or program objectives;\n\n(D) Are allowable under 2 CFR part 200, subpart E;\n\n(E) Are not paid by the Federal government under another Federal award, except where the Federal statute authorizing a program specifically provides that Federal funds made available for such program can be applied to cooperator resource contributions of other Federal programs;\n\n(F) Conform to other provisions of this Part, as applicable.\n\n(ii) Cooperator's share of contributions to the project may include:\n\n(A) Unrecovered indirect costs, including indirect costs of the cooperator's resource contributions. Unrecovered indirect cost means the difference between the amount charged to the award and the amount which could have been charged to the award under the cooperator's approved negotiated indirect cost rate.\n\n(B) Values for cooperator's contributions of services and property, established in accordance with 2 CFR 200.434. If the REE Agency authorizes the cooperator to donate buildings or land for construction/facilities acquisition projects or long term use, the value of the donated property for cooperator contributions must be the lesser of paragraph (b)(2)(ii)(B)( 1 ) or ( 2 ) of this section (refer to paragraph (b)(2)(ii)(H) of this section for more on the value of donated property):\n\n( 1 ) The value of the remaining life of the property recorded in the cooperator's accounting records at the time of donation.\n\n( 2 ) The current fair market value. However, when there is sufficient justification, the REE Agency may approve the use of the current fair market value of the donated property, even if it exceeds the value described in paragraph (b)(2)(ii)(B)( 1 ) of this section at the time of donation.\n\n(C) Volunteer services furnished by third-party professional and technical personnel, consultants, and other skilled and unskilled labor, if the service is an integral and necessary part of an approved project or program. Rates for third-party volunteer services must be consistent with those paid for similar work by the cooperator. In those instances in which the required skills are not found in the cooperator, rates must be consistent with those paid for similar work in the labor market in which the cooperator competes for the kind of services involved. In either case, paid fringe benefits that are reasonable, necessary, allocable, and otherwise allowable may be included in the valuation. (Refer to paragraph (b)(2)(ii)(H) of this section for more on third-party in-kind contributions.)\n\n(D) Donated employee services furnished by third-party organization. These services must be valued at the employee's regular rate of pay plus an amount of fringe benefits that is reasonable, necessary, allocable, and otherwise allowable, and indirect costs at either the third-party organization's approved federally negotiated indirect cost rate, or, a rate in accordance with 2 CFR 200.414(d), provided these services employ the same skill(s) for which the employee is normally paid. Where donated services are treated as indirect costs, indirect cost rates will separate the value of the donated services so that reimbursement for the donated services will not be made. (Refer to paragraph (b)(2)(ii)(H) of this section for more on third-party in-kind contributions.)\n\n(E) Donated property from third parties, which may include such items as office supplies, laboratory supplies, or workshop and classroom supplies. Value assessed to donated property included in the cooperator contributions must not exceed the fair market value of the property at the time of the donation. (Refer to paragraph (b)(2)(ii)(H) in this section for more on third-party in-kind contributions.)\n\n(F) Third-party-donated equipment, buildings and land. The method used for determining cooperator contributions for which title passes to the cooperator may differ according to the purpose of the Award, if paragraph (b)(2)(ii)(F)( 1 ) or ( 2 ) of this section apply:\n\n( 1 ) If the purpose of the Federal award is to assist the non-Federal entity in the acquisition of equipment, buildings or land, the aggregate value of the donated property may be claimed as cooperator resource contributions.\n\n( 2 ) If the purpose of the Award is to support activities that require the use of equipment, buildings or land, normally only depreciation charges for equipment and buildings may be made. However, the fair market value of equipment or other capital assets and fair rental charges for land may be allowed, provided that the REE Agency has approved the charges. See also 2 CFR 200.420.\n\n(G) The value of donated property must be determined in accordance with the usual accounting policies of the cooperator, with the following qualifications:\n\n( 1 ) The value of donated land and buildings must not exceed its fair market value at the time of donation to the Cooperator as established by an independent appraiser ( e.g.,  certified real property appraiser or General Services Administration representative) and certified by a responsible official of the cooperator as required by the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended, (42 U.S.C. 4601-4655) (Uniform Act) except as provided in the implementing regulations at 49 CFR part 24.\n\n( 2 ) The value of donated equipment must not exceed the fair market value of equipment of the same age and condition at the time of donation.\n\n( 3 ) The value of donated space must not exceed the fair rental value of comparable space as established by an independent appraisal of comparable space and facilities in a privately-owned building in the same locality.\n\n( 4 ) The value of loaned equipment must not exceed its fair rental value.\n\n(H) For third-party in-kind contributions, the fair market value of these goods and services must be documented and to the extent feasible supported by the same methods used internally by the cooperator.\n\n(c)  Indirect costs and tuition remission \u2014(1)  Reimbursement of indirect costs.
