(These preparations do not include products such as lipsticks or perfumes that serve to enhance appearance, or provide a pleasing odor, but do not enhance skin care. Also excluded are deodorants, manicure preparations, shaving preparations and non-medicated shampoos that do not function primarily as a skin treatment.)\n\n(c) The provisions of this part do not apply to wastewater discharges resulting from the manufacture of the following products, or as a result of providing one or more of the following services:\n\n(1) Surgical and medical instruments and apparatus reported under SIC 3841;\n\n(2) Orthopedic, prosthetic, and surgical appliances and supplies reported under SIC 3842;\n\n(3) Dental equipment and supplies reported under SIC 3843;\n\n(4) Medical laboratory services reported under SIC 8071;\n\n(5) Dental laboratory services reported under SIC 8072;\n\n(6) Outpatient care facility services reported under SIC 8081;\n\n(7) Health and allied services reported under SIC 8091, and not classified elsewhere;\n\n(8) Diagnostic devices other than those reported under SIC 3841;\n\n(9) Animal feed products that include pharmaceutical active ingredients such as vitamins and antibiotics, where the major portion of the product is non-pharmaceutical, and the resulting process wastewater is not characteristic of process wastewater from the manufacture of pharmaceutical products;\n\n(10) Food and beverage products fortified with vitamins or other pharmaceutical active ingredients, where the major portion of the product is non-pharmaceutical, and the resulting process wastewater is not characteristic of process wastewater from the manufacture of pharmaceutical products;\n\n(11) Pharmaceutical products and intermediates subject to the provisions of 40 CFR part 414, provided their manufacture results in less than 50 percent of the total flow of process wastewater that is regulated by 40 CFR part 414 at the facility."], ["40:40:32.0.1.1.15.0.4.2", 40, "Protection of Environment", "I", "N", "439", "PART 439\u2014PHARMACEUTICAL MANUFACTURING POINT SOURCE CATEGORY", "", "", "", "\u00a7 439.1 General definitions.", "EPA", "", "", "[63 FR 50425, Sept. 21, 1998; 64 FR 48104, Sept. 2, 1999, as amended at 68 FR 12270, Mar. 13, 2003]", "As used in this part:\n\n(a) The general definitions, abbreviations and methods of analysis in 40 CFR part 401 shall apply.\n\n(b)  Bench-scale operation  means the laboratory testing of materials, methods, or processes on a small scale, such as on a laboratory worktable.\n\n(c)  Cyanide (T)  means the parameter total cyanide.\n\n(d)  In-plant monitoring point  means a location within a plant, where an individual process effluent can be exclusively monitored before it is diluted or mixed with other process wastewaters en route to the end-of-pipe.\n\n(e)  Maximum daily  means the highest allowable discharge of wastewater pollutants during a calendar day or any 24 hour period that reasonably represents a calendar day for purposes of sampling.\n\n(f)  Maximum monthly average  means the highest allowable average of daily discharges of wastewater pollutants over a calendar month, and is calculated as the sum of all daily values measured during a calendar month divided by the number of daily values measured during that month.\n\n(g)  mg/L  means milligrams per liter or parts per million (ppm)\n\n(h)  Minimum level  means the level at which an analytical system gives recognizable signals and an acceptable calibration point.\n\n(i)  Nitrification capability  means the capability of a POTW treatment system to oxidize ammonia or ammonium salts initially to nitrites (via  Nitrosomonas  bacteria) and subsequently to nitrates (via  Nitrobacter  bacteria). Criteria for determining the nitrification capability of a POTW treatment system are: bioassays confirming the presence of nitrifying bacteria; and analyses of the nitrogen balance demonstrating a reduction in the concentration of ammonia or ammonium salts and an increase in the concentrations of nitrites and nitrates.\n\n(j)  Non-detect (ND)  means a concentration value below the minimum level that can be reliably measured by the analytical method.\n\n(k)  Pilot-scale operation  means processing equipment being operated at an intermediate stage between laboratory-scale and full-scale operation for the purpose of developing a new product or manufacturing process.\n\n(l)  POTW  means publicly owned treatment works (40 CFR 403.3).\n\n(m)  Process wastewater,  as defined at 40 CFR 122.2 and for the purposes of this part, does not include the following:\n\n(1) Trimethyl silanol, any active anti-microbial materials, process wastewater from imperfect fermentation batches, and process area spills. Discharges containing such materials are not subject to the limitations and standards of this part.\n\n(2) Non-contact cooling water, utility wastewaters, general site surface runoff, groundwater (e.g., contaminated groundwaters from on-site or off-site groundwater remediation projects), and other non-process water generated on site. Discharges of such waters and wastewaters are not subject to the limitations and standards of this part.\n\n(n)  Non-conventional pollutants  means parameters that are neither conventional pollutants (40 CFR 401.16), nor \u201ctoxic\u201d pollutants (40 CFR 401.15).\n\n(o)  Surrogate pollutant  means a regulated parameter that, for the purpose of compliance monitoring, is allowed to serve as a surrogate for a group of specific regulated parameters. Plants would be allowed to monitor for a surrogate pollutant(s), when the other parameters for which it stands are receiving the same degree of treatment as the surrogate pollutant(s) and all of the parameters discharged are in the same treatability class(es) as their respective surrogate pollutant(s). Permit limits and compliance monitoring are not required for regulated pollutants that are neither used nor generated at the facility. Except for cyanide, for which an alternate monitoring requirement is established in subparts A and C of this part, a determination that regulated pollutants are neither used nor generated should be based on a review of all raw materials in use, and an assessment of the process chemistry, products and by-products resulting from each of the manufacturing processes. This determination along with a recommendation of any surrogate must be submitted with permit applications for approval by the permitting authority, reconfirmed by an annual chemical analysis of wastewater from each monitoring location, and measurement of a non-detect value for each regulated pollutant or its surrogate. These residual amounts may be included in the calculation of the average influent BOD 5  loading.\n\n(3) The practices of recovery, and/or separate disposal or reuse include: physical separation and removal of separable mycelia; recovery of solvents from waste streams; incineration of concentrated solvent wastestreams (including tar still bottoms); and concentration of broth for disposal other than to the treatment system. This part does not prohibit the inclusion of such wastes in raw waste loads in fact, nor does it mandate any specific practice, but rather describes the rationale for determining NPDES permit limitations. The effluent limitation for BOD 5  may be achieved by any of several, or a combination, of these practices.\n\n(b) The maximum monthly average limitation for TSS, expressed as mass loading (lbs., kg) per day, must be calculated as 1.7 times the BOD 5  limitation determined in paragraph (a) of this section.\n\n(c) Except as provided in paragraph (d) of this section, the limitations for COD are as follows:\n\nEffluent Limitations (BPT)\n\n1 mg/L (ppm).\n\n(d) If the maximum monthly average COD concentration in paragraph (c) of this section is higher than a concentration value reflecting a reduction in the long-term average daily COD load in the raw (untreated) process wastewater of 74 percent multiplied by a variability factor of 2.2, then the monthly average limitation for COD corresponding to the lower concentration value must be applied.\n\n(e) The effluent limitations for cyanide are as follows:\n\nEffluent Limitations (BPT)\n\n1 mg/L (ppm).\n\n(f) When monitoring for cyanide at the end-of-pipe is impractical because of dilution by other process wastewaters, compliance with the cyanide effluent limitations in paragraph (e) of this section must be demonstrated at in-plant monitoring points pursuant to 40 CFR 122.44(i) and 122.45(h). No facility shall be required to attain a limitation for COD that is less than the equivalent of 220 mg/L.\n\n(d) The long-term average daily BOD 5  or COD mass loading of the raw process wastewater ( i.e.,  the base number to which the percent reduction is applied) is defined as the average daily BOD 5  or COD load during any calendar month, over 12 consecutive months within the most recent 36 months.\n\n(1) To assure equity in the determination of NPDES permit limitations regulating discharges subject to this subpart, calculation of the long-term average daily BOD 5  or COD load in the influent to the wastewater treatment system must exclude any portion of the load associated with solvents, except for residual amounts of solvents remaining after the practices of recovery and/or separate disposal or reuse. Residual amounts of these substances may be included in the calculation of the average influent BOD 5  or COD loading.\n\n(2) The practices of recovery, and/or separate disposal or reuse include: recovery of solvents from wastestreams; and incineration of concentrated solvent wastestreams (including tar still bottoms). This regulation does not prohibit the inclusion of such wastes in raw waste loads in fact, nor does it mandate any specific practice, but rather describes the rationale for determining NPDES permit limitations. The voluntary Food Safety and Inspection Service (FSIS) program in which non-Federal laboratories are accredited as capable of performing analyses with the level of quality that is necessary to maintain accreditation in the program, on samples of raw or processed meat, poultry, and egg products, and through which a proficiency testing sample program for quality assurance is conducted.\n\n(b)  Food chemistry.  Analysis of raw or processed meat or poultry products for the components moisture, protein, fat, and salt.\n\n(c)  Initial accreditation proficiency testing sample.  A sample provided by the FSIS ALP to a non-Federal laboratory to determine whether the laboratory's analytical capability meets the standards for acceptance into the program. The concentration or presence of the targeted analyte(s) and the composition of the components in the sample is unknown to the laboratory.\n\n(d)  Inter-laboratory accreditation maintenance proficiency testing sample. The application must specify the kinds of accreditation sought by the owner or manager of the laboratory. The second set of proficiency testing samples will be analyzed only for the analyte(s) or analyte classes for which unacceptable initial results had been obtained by the laboratory.\n\n(ii) If the results of the second set of proficiency testing samples are unsuccessful, the laboratory may request a third set of proficiency testing samples after a 60-day waiting period, commencing from the date of notification by FSIS of unsuccessful results. The third set of proficiency testing samples will be analyzed only for the analyte(s) or analyte classes for which unacceptable initial results had been obtained by the laboratory.\n\n(iii) If the laboratory is unsuccessful for the third set and still wishes to pursue accreditation, the ALP will require a new application and an application fee if the initial accreditation process is not completed within eleven months. To maintain accreditation, an analytical laboratory must fulfill the requirements of this section.\n\n(b)  Records.  To demonstrate traceable and appropriate application of equipment, standards, procedures, analysts, and approvals related to accreditation, an accredited laboratory must:\n\n(1) Maintain laboratory quality control records for the most recent three years that samples have been analyzed.\n\n(2) Maintain complete records of the receipt, analysis, and disposition of samples for the most recent three years that samples have been analyzed.\n\n(3) Maintain in a secure electronic format or in a standards book, all records, readings, and calculations for prepared standards. Entries are to be dated and the analyst identified at the time of the entry, and manual calculations verified and documented by the supervisor, or by the supervisor's designee, before use of the standard. The standards records are to be retained for three years after the last recorded entry. The certificates of analysis are to be kept on file for purchased standards for at least the period of time that the materials are in use.\n\n(4) Maintain records of instrument maintenance and calibration. The records are to be retained for three years after the last recorded entry.\n\n(5) As provided in paragraph (e) of this section, records are to be made available for review by any duly authorized representative of the Secretary of Agriculture, including ALP personnel or their designees.\n\n(c)  Inter-laboratory accreditation maintenance proficiency testing sample.  (1) An accredited laboratory must analyze inter-laboratory accreditation maintenance proficiency testing samples and return the results to the ALP by the due date, which is usually within approximately three weeks of sample receipt. This must be done whenever requested by FSIS and at no cost to FSIS.\n\n(2) Results must be those of the accredited laboratory. Analyses of proficiency testing samples must not be contracted out by the accredited laboratory.\n\n(d)  Corporate changes.  The ALP must be informed within 30 days of any change of address or in the laboratory's ownership, officers, directors, supervisory personnel, or other responsibly connected individual or entity.\n\n(e)  On-site review.  An accredited laboratory must permit any duly authorized representative of the Secretary to perform both announced and unannounced on-site laboratory reviews of facilities and records, both hard copy and electronic, during normal business hours, and to copy any records pertaining to the laboratory's participation in the ALP.\n\n(f)  Analytical test procedures.  An accredited laboratory must use analytical test procedures designated by the FSIS ALP as being acceptable. FSIS and some AOAC analytical test procedures are acceptable.\n\n(g)  Quality assurance levels.  An accredited laboratory must demonstrate the capability to maintain quality assurance levels that are within acceptable limits as evaluated by the ALP in the analysis of inter-laboratory accreditation maintenance proficiency testing samples for the analyte category for which accreditation was granted. An accredited laboratory will successfully demonstrate the maintenance of these capabilities if its results from inter-laboratory accreditation maintenance proficiency testing samples satisfy ALP evaluation criteria based on the ISO 13528 standard, to include performance evaluation by  z  score statistics.\n\n(h)  Fees.  An accredited laboratory must pay the annual required accreditation fee when it is due.\n\n(i)  Probation.  If placed on probation, an accredited laboratory must meet the ALP requirements as prescribed in this section in order to remove the probation status.\n\n(1) The laboratory must successfully analyze a set of initial accreditation proficiency testing samples for the analyte(s) that triggered the probation and submit the analytical results to FSIS by the due date, which is typically within approximately three weeks of receipt of the samples.\n\n(2) Similarly satisfy criteria for accreditation maintenance proficiency testing samples specified by the ALP in this part.\n\n(3) Provide written corrective action documentation, related to the issue that triggered the probation, to the ALP by the date required.\n\n(j)  Suspension.  If placed on suspension, an accredited laboratory must meet the ALP requirements as prescribed in this section in order to remove the suspension status. If the laboratory is unsuccessful in meeting the requirements to remove the suspension status, accreditation will be revoked.\n\n(1) Laboratories that are suspended due to performance or response issues enter a waiting period of 60 days from the effective date of that action. After the 60-day period has passed, if the laboratory wishes to pursue reinstatement to the ALP, the laboratory must submit a written corrective action plan specifying what corrections were made and illustrate to FSIS that the corrections are effective or would reasonably be expected to be effective.\n\n(i) After the corrective action plan has been accepted by the ALP, the laboratory must successfully analyze a set of initial accreditation proficiency testing samples for the analyte(s) that triggered the suspension and meet all other program requirements including payment of any annual fees that are due.
