These records include records pertaining to the fitness of individuals to be registered with the Commission and engage in business activities that are subject to the Commission's jurisdiction and records pertaining to disciplinary or other adverse action investigated or taken with respect to individual registrants. Pursuant to 5 U.S.C. 552a(k)(2) and subject to the requirements and limitations set forth therein, the Commission is exempting this system of records from the following provisions of the Privacy Act: 5 U.S.C. 552a(c)(3); (d)(1) through (4); (e)(1); (e)(4)(G) through (I); and (f), and from the following corresponding sections of these rules: \u00a7\u00a7 146.3; 146.5; 146.6(d); 146.11(a)(7) through (9); and 146.7(a). The system of records identified as CFTC-31 Closed Commission Meetings contains records about individuals who are the subject of discussion at closed Commission meetings, including those who are the subject of investigations or who are being considered for employment. These records may include statements from individuals who have provided information in the course of an applicant's or employee's background investigation or other Commission investigation and who have requested that their identities remain confidential. Pursuant to 5 U.S.C. 552a(k)(2) and (5) and subject to the requirements and limitations set forth therein, the Commission is exempting this system of records from the following provisions of the Privacy Act: 5 U.S.C. 552a(c)(3); (d)(1) through (4); (e)(1); (e)(4)(G) through (I); and (f), and from the following corresponding sections of these rules: \u00a7\u00a7 146.3; 146.5; 146.6(d); 146.11(a)(7) through (9); and 146.7(a). Pursuant to 5 U.S.C. 552a(j)(2) and subject to the requirements and limitations set forth therein, the Commission is exempting this system of records from the following provisions of the Privacy Act: 5 U.S.C. 552a(c)(3) and (4); (d)(1) through (4); (e)(1) through (3), (e)(4)(G) through (I), and (e)(5) and (8); (f); and (g), and from the following corresponding sections of these rules: \u00a7\u00a7 146.3; 146.4; 146.5; 146.6(b), (d), and (e); 146.7(a), (c), and (d); 146.8; 146.9; 146.10; and 146.11(a)(7) through (9). Allowing the subject of the investigation to amend records in this system of records could likewise interfere with ongoing law enforcement proceedings and impose an impossible administrative burden by requiring law enforcement investigations to be continuously reinvestigated.\n\n(4) From section (e)(1) (Relevancy and Necessity of Information) and (5) (Accuracy, Timeliness, Relevance, and Completeness), because in the course of investigations into potential violations of law, the significance of certain information may not be clear or the information may not be strictly relevant or necessary to a specific investigation; but, effective law enforcement requires the retention of all information that may aid in establishing patterns of unlawful activity and providing investigative leads.\n\n(5) From section (e)(2) (Collect from Individual), because in a law enforcement investigation the requirement that information be collected to the greatest extent possible from the subject individual would present a serious impediment to law enforcement, in that the subject of the investigation would be informed of the existence of the investigation and would therefore be able to avoid detection, apprehension, or legal obligations or duties.\n\n(6) From section (e)(3) (Privacy Act Statement), because to comply with the requirements of this section during the course of an investigation could impede the information gathering process and hamper the investigation.\n\n(7) From sections (e)(4)(G) through (I) (Agency Requirements), and (f) (Agency Rules), because the Commission is not required to establish requirements, rules, or procedures related to access and amendment of records in a system of records that is exempt from the individual access and amendment provisions in section (d) of the Privacy Act.\n\n(8) From section (e)(8) (Serve Notice), because the application of this provision could prematurely reveal an ongoing criminal investigation to the subject of the investigation, present a serious impediment to law enforcement by interfering with the ability to issue subpoenas or otherwise gather information, and reveal investigative techniques, procedures, or evidence.\n\n(9) From section (g) (Civil Remedies), because this system of records is exempt from the individual access and amendment provisions in section (d) of the Privacy Act for the reasons stated in paragraph (e)(3) of this section; therefore, the Commission is not subject to civil action for failure to adhere to those requirements.\n\n(f)  CFTC-44 Personnel Clearance System.  The system of records identified as CFTC-44 Personnel Clearance System contains records related to the background investigations and security clearances of individuals who have been or are being considered for access to Commission facilities, information technology systems, and classified or confidential information. These records may include statements from individuals who have provided information in the course of a background investigation and have requested that their identity remain confidential. Pursuant to 5 U.S.C. 552a(k)(2) and (5) and subject to the requirements and limitations set forth therein, the Commission is exempting this system of records from the following provisions of the Privacy Act: 5 U.S.C. 552a(c)(3); (d)(1) through (4); (e)(1); (e)(4)(G) through (I); and (f), and from the following corresponding sections of these rules: \u00a7\u00a7 146.3; 146.5; 146.6(d); 146.11(a)(7) through (9); and 146.7(a). Exemptions from these particular sections of the Privacy Act are justified for the following reasons:\n\n(1) From sections (c)(3) (Accounting of Certain Disclosures), because release of the accounting of certain disclosures could alert the subject of an investigation to the extent of that investigation and reveal investigative interests of the Commission and the recipient entity that were previously unknown to the individual. Release of such information to the subject of an investigation could reasonably be anticipated to impede and interfere with the Commission's efforts to adequately assess an individual when making a decision about the individual's access to Commission facilities, information technology systems, and classified and confidential information.\n\n(2) From sections (d)(1) through (4) (Access and Amendment), because the records contained in this system may be related to ongoing investigations, and individual access to these records could alert the subject of an investigation to the extent of that investigation and reveal investigative interests of the Commission and others that were previously unknown to the individual. Providing a subject with access to these records could impair the effectiveness of the Commission's investigations and could significantly impede the investigation by providing the opportunity for the subject to destroy documentary evidence, improperly influence witnesses and confidential sources, fabricate testimony, and engage in other activities that could compromise the investigation. In addition, providing an individual with access to these records may reveal the identity of a source who furnished information under an express promise that their identity would remain confidential. Amendment of the records in this system of records would interfere with ongoing law enforcement proceedings and impose an impossible administrative burden by requiring law enforcement investigations to be continuously reinvestigated.\n\n(3) From section (e)(1) (Relevancy and Necessity of Information), because in the course of conducting and adjudicating background investigations, the significance of certain information may not be clear or the information may not be strictly relevant or necessary to a specific investigation; but, effective investigations require the retention of all information that may aid in the investigation and provide investigative leads.\n\n(4) From sections (e)(4)(G) through (I) (Agency Requirements), and (f) (Agency Rules), because the Commission is not required to establish requirements, rules, or procedures related to access and amendment of records in a system of records that is exempt from the individual access and amendment provisions in section (d) of the Privacy Act.\n\n(g)  CFTC-49 Whistleblower Records.  The system of records identified as CFTC-49 Whistleblower Records contains records related to whistleblower tips, complaints and referrals, records related to investigations and inquiries into whistleblower complaints, and records related to the whistleblower award claim and determination process. Pursuant to 5 U.S.C. 552a(k)(2) and subject to the requirements and limitations set forth therein, the Commission is exempting this system of records from the following provisions of the Privacy Act: 5 U.S.C. 552a(c)(3); (d)(1) through (4); (e)(1); (e)(4)(G) through (I); and (f), and from the following corresponding sections of these rules: \u00a7\u00a7 146.3; 146.5; 146.6(d); 146.11(a) through (9); and 146.7(a). The quality of a lot shall be considered acceptable when the number of defectives does not exceed the acceptance number in the sampling plans.\n\n(2)  Fill of container.  A lot shall be deemed to be in compliance for fill of container when the number of defectives does not exceed the acceptance number (c) in the sampling plans.\n\n(h) The sampling and acceptance procedure means the following:\n\n(1)  Definitions \u2014(i)  Lot.  A collection of primary containers or units of the same size, type, and style manufactured or packed under similar conditions and handled as a single unit of trade.\n\n(ii)  Lot size.  The number of primary containers or units in the lot.\n\n(iii)  Sample size.  The total number of sample units drawn for examination from a lot.\n\n(iv)  Sample unit.  A container, a portion of the contents of a container, or a composite mixture of product from small containers that is sufficient for the examination or testing as a single unit.\n\n(v)  Defective.  Any sample unit shall be regarded as defective when the sample unit does not meet the criteria set forth in the standards.\n\n(vi)  Acceptance number  ( c ). The maximum number of defective sample units permitted in the sample in order to consider the lot as meeting the specified requirements.\n\n(vii)  Acceptable quality level  ( AQL ). The addition of concentrated juice from  Citrus reticulata  or  Citrus aurantium,  or both, shall not exceed, on a single-strength basis, the 10 percent maximum for  Citrus reticulata  and the 5 percent maximum for  Citrus aurantium  prescribed by this paragraph. (1) The standard of quality for pineapple juice is as follows:\n\n(i) The soluble solids content of pineapple juice (exclusive of added sugars) without added water shall not be less than 10.5\u00b0 Brix as determined by refractometer at 20 \u00b0C uncorrected for acidity and read as degrees Brix on International Sucrose Scales. Where the juice has been obtained using concentrated juice with addition of water, the soluble pineapple juice solids content (exclusive of added sugars) shall be not less than 12.8\u00b0 Brix, uncorrected for acidity and read as degrees Brix on the International Sucrose Scales.\n\n(ii) The acidity, as determined by the method prescribed in paragraph (b)(2)(ii) of this section, is not more than 1.35 grams of anhydrous citric acid per 100 milliliters of the juice.\n\n(iii) The ratio of the degrees Brix to total acidity, as determined by the method prescribed in paragraph (b)(2)(iii) of this section, is not less than 12.\n\n(iv) The quantity of finely divided \u201cinsoluble solids\u201d, as determined by the method prescribed in paragraph (b)(2)(iv) of this section, is not less than 5 percent nor more than 30 percent.\n\n(2) The methods referred to in paragraph (b)(1) of this section are as follows:\n\n(i) Determine the degrees Brix of the pineapple juice by the method prescribed in \u201cOfficial Methods of Analysis of the Association of Official Analytical Chemists,\u201d 13th Ed. (1980), section 31.009, \u201cSolids by Means of Spindle\u2014Official Final Action,\u201d which is incorporated by reference. For information on the availability of this material at NARA, call 202-741-6030, or go to:  http://www.archives.gov/federal_register/code_of_federal_regulations/ibr_locations.html.\n\n(ii) Determine the total acidity of the pineapple juice by titration by the method prescribed in \u00a7 145.180(b)(2)(ix) of this chapter.\n\n(iii) Divide the degrees Brix determined as prescribed in paragraph (b)(2)(i) of this section by the grams of anhydrous citric acid per 100 milliliters of juice, determined as prescribed in paragraph (b)(2)(ii) of this section, and report the results as ratio of degrees Brix to total acidity.\n\n(iv) Determine the quantity of \u201cinsoluble solids\u201d in pineapple juice as follows: Measure 50 milliliters of thoroughly stirred pineapple juice into a cone-shaped graduated tube of the long-cone type, measuring approximately 4\n 3/16  inches from tip to top calibration and having a capacity of 50 milliliters. Place the tube in a suitable centrifuge the approximate speed of which is related to diameter of swing in accordance with the table immediately below. The word \u201cdiameter\u201d means the over-all distance between the tips of opposing centrifuge tubes in operating position.\n\nThe milliliter reading at the top of the layer of \u201cinsoluble solids,\u201d after centrifuging 3 minutes, is multiplied by two to obtain the percentage of \u201cinsoluble solids.\u201d\n\n(3) If the quality of pineapple juice falls below the standard prescribed in paragraph (b)(1) of this section, the label shall bear the general statement of substandard quality specified in \u00a7 130.14 (a) of this chapter, in the manner and form therein specified.\n\n(c)  Fill of container. Either before or after such heat treatment, all or a part of the product may be frozen. The finished pasteurized orange juice contains not less than 10.5 percent by weight of orange juice soluble solids, exclusive of the solids of any added optional sweetening ingredients, and the ratio of the Brix hydrometer reading to the grams of anhydrous citric acid per 100 milliliters of juice is not less than 10 to 1.\n\n(b) The optional concentrated orange juice ingredients referred to in paragraph (a) of this section are frozen concentrated orange juice as specified in \u00a7 146.146 and concentrated orange juice for manufacturing as specified in \u00a7 146.153 when made from mature oranges; but the quantity of such concentrated orange juice ingredients added shall not contribute more than one-fourth of the total orange juice solids in the finished pasteurized orange juice.\n\n(c) The optional sweetening ingredients referred to in paragraph (a) of this section are sugar, invert sugar, dextrose, dried corn sirup, dried glucose sirup.\n\n(d)(1) The name of the food is \u201cPasteurized orange juice\u201d. If the food is filled into containers and preserved by freezing, the label shall bear the name \u201cFrozen pasteurized orange juice\u201d. The words \u201cpasteurized\u201d or \u201cfrozen pasteurized\u201d shall be shown on labels in letters not less than one-half the height of the letters in the words \u201corange juice\u201d.\n\n(2) If the pasteurized orange juice is filled into containers and refrigerated, the label shall bear the name of the food, \u201cchilled pasteurized orange juice\u201d. If it does not purport to be either canned orange juice or frozen pasteurized orange juice, the word \u201cchilled\u201d may be omitted from the name. HUD will take no further action on the complaint unless the complainant or the recipient fails to comply with the agreement.\n\n(d) The mediator shall protect the confidentiality of information obtained in the course of the mediation process. No mediator shall testify in any adjudicative proceeding, produce any document, or otherwise disclose any information obtained in the course of the mediation process without the prior approval of the head of the mediation agency.\n\n(e) HUD shall use the mediation process for a maximum of 60 days after receiving a complaint. Cases settled in mediation or before hearing will not involve termination of a recipient's Federal financial assistance from HUD.\n\n(2) Any other means authorized by law, including, but not limited to:\n\n(i) Referral to the Department of Justice for proceedings to enforce any rights of the United States or obligations of the recipient created by the Act or this part;\n\n(ii) Use of any requirement of, or referral to, any Federal, State or local government agency that will have the effect of correcting a violation of the Act or this part.\n\n(b) Whenever the Secretary determines that a State or unit of general local government which is a recipient of Federal financial assistance under Title I of the Housing and Community Development Act of 1974, 42 U.S.C. 5301-5317, has failed to comply with requirements of the Age Discrimination Act or this part with respect to a program or activity funded in whole or in part with such assistance, he or she shall notify the Governor of such State or the chief executive officer of such unit of general local government of the noncompliance and shall request the Governor or chief executive officer to secure compliance. If within a reasonable period of time, not to exceed 60 days, the Governor or chief executive officer fails or refuses to secure compliance, the Secretary is authorized to take the action specified in (a) of this section, exercise the powers and functions provided for in section 111(a) of the Housing and Community Act of 1974, 42 U.S.C. 5311(a), or take such other action as may be provided by law.\n\n(c) HUD shall limit any termination under \u00a7 146.35 to the particular recipient and particular program or activity HUD finds to be in violation of this part. HUD shall not base any part of a termination on a finding with respect to any program or activity of the recipient which does not receive Federal financial assistance from HUD.\n\n(d) HUD shall take no action under paragraph (a) of this section until:\n\n(1) The Secretary has advised the recipient of its failure to comply with the Act or this part and has determined that voluntary compliance cannot be achieved.\n\n(2) Thirty days have elapsed after the Secretary has submitted a written report of the circumstances and grounds of the action to the committees of the Congress having legislative jurisdiction over the Federal program or activity involved. A report shall be filed whenever any action is taken under paragraph (a) of this section.\n\n(e)(1) The Secretary may defer the provision of new Federal financial assistance to a recipient when termination proceedings under this section are initiated.\n\n(2) New financial assistance from HUD includes all assistance for which HUD requires an application, approval, or submissions under the Community Development Block Grant program including renewal or continuation of existing activities, or authorization of new activities, during the deferral period. New financial assistance from HUD does not include increases in funding as a result of changed computation for formula awards or assistance approved before the beginning of a hearing under this section.\n\n(3) HUD shall not impose a deferral until the recipient has received a notice of an opportunity for a hearing under this section. HUD shall not continue a deferral for more than 60 days unless a hearing has begun within that time or the time for beginning the hearing has been extended by mutual consent of the recipient and the Secretary. If a work vest is found not to be in a serviceable condition, then such work vest shall be removed from the OCS facility. If the OCMI determines that any item is not addressed, the OCMI stamps the EEP \u201cRETURNED FOR REVISION\u201d and returns the EEP, together with an explanation of the EEP's deficiencies, to the operator.\n\n(b) Once the EEP is approved under paragraph (a) of this section, the facility operator shall ensure that a copy of the EEP and the letter indicating Coast Guard approval is maintained on the facility.\n\n(c) The EEP must be resubmitted for approval when substantive changes are made to the EEP. Only the pages affected by a change need be resubmitted if the EEP is bound in such a way as to allow old pages to be removed easily and new ones inserted. Substantive changes include, but are not limited to, installation of a new facility within the area covered by an EEP, relocation of a MODU, changes in the means or methods of evacuation, or changes in the time required to accomplish evacuation.\n\n(d) The EEP must, at a minimum,\n\n(1) Be written in language that is easily understood by the facility's operating personnel;\n\n(2) Have a table of contents and general index;\n\n(3) Have a record of changes;\n\n(4) List the name, telephone number, and function of each person to be contacted under the EEP and state the circumstances in which that person should be contacted;\n\n(5) List the facility's communications equipment, its available frequencies, and the communications schedules with shore installations, standby vessels, rescue aircraft, and other OCS facilities specified in the EEP;\n\n(6) Identify the primary source of weather forecasting relied upon in implementing the EEP and state the frequency of reports when normal weather is forecasted, the frequency of reports when heavy weather is forecasted, and the method of transmitting the reports to the facility;\n\n(7) Designate the individual on each facility covered by the EEP who is assigned primary responsibility for implementing the EEP;\n\n(8) Designate those facility and shoreside support personnel who have the authority to advise the person in charge of the facility as to the best course of action to be taken and who initiate actions to assist facility personnel;\n\n(9) Describe the recognized circumstances, such as fires or blowouts, and environmental conditions, such as approaching hurricanes or ice floes, in which the facility or its personnel would be placed in jeopardy and a mass evacuation of the facility's personnel would be recommended;\n\n(10) For each of the circumstances and conditions described under paragraph (d)(9) of this section, list the pre-evacuation steps for securing operations, whether drilling or production, including the time estimates for completion and the personnel required;\n\n(11) For each of the circumstances and conditions described under paragraph (d)(9) of this section, describe the order in which personnel would be evacuated, the transportation resources to be used in the evacuation, the operational limitations for each mode of transportation specified, and the time and distance factors for initiating the evacuation; and\n\n(12) For each of the circumstances and conditions described under paragraph (d)(9) of this section, identify the means and procedures\u2014\n\n(i) For retrieving persons from the water during an evacuation;\n\n(ii) For transferring persons from the facility to designated standby vessels, lifeboats, or other types of evacuation craft;\n\n(iii) For retrieving persons from designated standby vessels, lifeboats, or other types of evacuation craft if used; and\n\n(iv) For the ultimate evacuation of all persons on the facility to land, another facility, or other location where the evacuees would be reasonably out of danger under the circumstance or condition being addressed.\n\n(e) The operator shall ensure that\u2014\n\n(1) All equipment specified in the EEP, whether the equipment is located on or off of the facility, is made available and located as indicated in the EEP and is designed and maintained so as to be capable of performing its intended function during an emergency evacuation;\n\n(2) All personnel specified in the EEP are available and located as specified in the EEP and are trained in fulfilling their role under the EEP; If a standby vessel is designated for that facility in the EEP, the vessel must be positioned as described in the EEP for an evacuation of that facility and the vessel's crew must demonstrate its ability to perform its duties and functions under the EEP.\n\n(d) The date and time of such drills shall be reported in writing by the person in charge at the time of the drill to the owner who shall maintain this report record for a year and furnish it upon request to the Coast Guard. After one year, such records may be destroyed. The owner or operator of each vessel subject to this section must submit an initial NOA to the National Vessel Movement Center (NVMC):\n\n(1) If the voyage time is more than 96 hours, at least 96 hours before the vessel arrives at a place on the OCS from a foreign port or place or from a different OCS block area to engage in OCS activities;\n\n(2) If the voyage time is less than 96 hours and more than 24 hours, before departure, or;\n\n(3) If the voyage time is less than 24 hours, at least 24 hours before the vessel arrives at a place on the OCS.\n\n(b)  Information required in an NOA.  The following information is required from the owners or operators of vessels submitting an NOA:\n\n(1) All the information specified in 33 CFR Table 160.206 with the exception of information required in items (2)(iii) through (2)(vi) and item (6). Item (8) is also not required except as pursuant to the laws on vessel entry (19 U.S.C. 1434) and clearance (46 U.S.C. 60105). Vessel owners and operators should protect any personal information they gather in preparing notices for transmittal to the NVMC so as to prevent unauthorized disclosure of that information;\n\n(2) The area in which they are conducting their operations. This area can be submitted as either the name of the places, the BOEM block numbers, or the latitudes and longitudes of the places on the OCS where operations are being conducted; and\n\n(3) If any person onboard, including a crewmember, is not required to carry a passport for travel, then passport information required in Table 160.206, items (4)(iv) through (vi), and (5)(iv) through (vi), need not be provided for that person.\n\n(c)  Updates to a submitted NOA.  Unless otherwise specified in this section, whenever the most recently submitted NOA information becomes inaccurate, the owner or operator of that vessel must revise and re-submit the NOA within the times required in paragraph (e) of this section. An owner or operator does not need to revise and re-submit an NOA for the following:\n\n(1) A change in submitted arrival time that is less than 6 hours;\n\n(2) Changes in the location, latitude and longitude, of the vessel from the location at the time the NOA was reported; or\n\n(3) Changes to personnel positions or duties on the vessel.\n\n(d)  Methods of submission.  The notice must be submitted to the NVMC by electronic Notice of Arrival and Departure format using methods specified at the NVMC's Web site at  http://www.nvmc.uscg.gov/.\n\n(e)  Required reporting time of an NOA update. The Director shall prescribe aquifer cleanup and monitoring where he deems it necessary and feasible to insure adequate protection of USDWs.\n\n(b) Requirements for Class IV wells. For RCRA, application also includes the information required by the Director under \u00a7 122.25 (contents of Part B of the RCRA application).\n\nAquifer  means a geological formation, group of formations, or part of a formation that is capable of yielding a significant amount of water to a well or spring.\n\nArea of review  means the area surrounding an injection well described according to the criteria set forth in \u00a7 146.06 or in the case of an area permit, the project area plus a circumscribing area the width of which is either \n 1/4  of a mile or a number calculated according to the criteria set forth in \u00a7 146.06.\n\nCasing  means a pipe or tubing of appropriate material, of varying diameter and weight, lowered into a borehole during or after drilling in order to support the sides of the hole and thus prevent the walls from caving, to prevent loss of drilling mud into porous ground, or to prevent water, gas, or other fluid from entering or leaving the hole.\n\nCatastrophic collapse  means the sudden and utter failure of overlying \u201cstrata\u201d caused by removal of underlying materials.\n\nCementing  means the operation whereby a cement slurry is pumped into a drilled hole and/or forced behind the casing.\n\nCesspool  means a \u201cdrywell\u201d that receives untreated sanitary waste containing human excreta, and which sometimes has an open bottom and/or perforated sides.\n\nConfining bed  means a body of impermeable or distinctly less permeable material stratigraphically adjacent to one or more aquifers.\n\nConfining zone  means a geological formation, group of formations, or part of a formation that is capable of limiting fluid movement above an injection zone.\n\nContaminant  means any physical, chemical, biological, or radiological substance or matter in water.\n\nConventional mine  means an open pit or underground excavation for the production of minerals.\n\nDirector  means the Regional Administrator, the State director or the Tribal director as the context requires, or an authorized representative. When there is no approved State or Tribal program, and there is an EPA administered program, \u201cDirector\u201d means the Regional Administrator. When there is an approved State or Tribal program, \u201cDirector\u201d normally means the State or Tribal director. In some circumstances, however, EPA retains the authority to take certain actions even when there is an approved State or Tribal program. (For example, when EPA has issued an NPDES permit prior to the approval of a State program, EPA may retain jurisdiction over that permit after program approval; see \u00a7 123.69). In such cases, the term  Director  means the Regional Administrator and not the State or Tribal director.\n\nDisposal well  means a well used for the disposal of waste into a subsurface stratum.\n\nDrywell  means a well, other than an improved sinkhole or subsurface fluid distribution system, completed above the water table so that its bottom and sides are typically dry except when receiving fluids.\n\nEffective date of a UIC program  means the date that a State UIC program is approved or established by the Administrator.\n\nEnvironmental Protection Agency  (\u201cEPA\u201d) means the United States Environmental Protection Agency.\n\nEPA  means the United States \u201cEnvironmental Protection Agency.\u201d\n\nExempted aquifer  means an aquifer or its portion that meets the criteria in the definition of \u201cunderground source of drinking water\u201d but which has been exempted according to the procedures of \u00a7 144.8(b).\n\nExisting injection well  means an \u201cinjection well\u201d other than a \u201cnew injection well.\u201d\n\nExperimental technology  means a technology which has not been proven feasible under the conditions in which it is being tested.\n\nFacility or activity  means any \u201cHWM facility,\u201d UIC \u201cinjection well,\u201d NPDES \u201cpoint source,\u201d or State 404 dredge and fill activity, or any other facility or activity (including land or appurtenances thereto) that is subject to regulation under the RCRA, UIC, NPDES, or 404 programs.\n\nFault  means a surface or zone of rock fracture along which there has been displacement.\n\nFlow rate  means the volume per time unit given to the flow of gases or other fluid substance which emerges from an orifice, pump, turbine or passes along a conduit or channel.\n\nFluid  means material or substance which flows or moves whether in a semisolid, liquid, sludge, gas, or any other form or state.\n\nFormation  means a body of rock characterized by a degree of lithologic homogeneity which is prevailingly, but not necessarily, tabular and is mappable on the earth's surface or traceable in the subsurface.\n\nFormation fluid  means \u201cfluid\u201d present in a \u201cformation\u201d under natural conditions as opposed to introduced fluids, such as drilling mud.\n\nGenerator  means any person, by site location, whose act or process produces hazardous waste identified or listed in 40 CFR part 261.\n\nGround water  means water below the land surface in a zone of saturation.\n\nHazardous waste  means a hazardous waste as defined in 40 CFR 261.3.\n\nHazardous Waste Management facility  (\u201cHWM facility\u201d) means all contiguous land, and structures, other appurtenances, and improvements on the land used for treating, storing, or disposing of hazardous waste. A facility may consist of several treatment, storage, or disposal operational units (for example, one or more landfills, surface impoundments, or combination of them).\n\nHWM facility  means \u201cHazardous Waste Management facility.\u201d\n\nImproved sinkhole  means a naturally occurring karst depression or other natural crevice found in volcanic terrain and other geologic settings which have been modified by man for the purpose of directing and emplacing fluids into the subsurface.\n\nIndian Tribe  means any Indian Tribe having a Federally recognized governing body carrying out substantial governmental duties and powers over a defined area.\n\nInjection well  means a \u201cwell\u201d into which \u201cfluids\u201d are being injected.\n\nInjection zone  means a geological \u201cformation\u201d, group of formations, or part of a formation receiving fluids through a well.\n\nLithology  means the description of rocks on the basis of their physical and chemical characteristics.\n\nOwner or operator  means the owner or operator of any facility or activity subject to regulation under the RCRA, UIC, NPDES, or 404 programs.\n\nPacker  means a device lowered into a well to produce a fluid-tight seal.\n\nPermit  means an authorization, license, or equivalent control document issued by EPA or an \u201capproved State\u201d to implement the requirements of this part and parts 124, 144, and 145. Permit does not include RCRA interim status (\u00a7 122.23), UIC authorization by rule (\u00a7\u00a7 144.21 to 144.26 and 144.15), or any permit which has not yet been the subject of final agency action, such as a \u201cdraft permit\u201d or a \u201cproposed permit.\u201d\n\nPlugging  means the act or process of stopping the flow of water, oil or gas into or out of a formation through a borehole or well penetrating that formation.\n\nPlugging record  means a systematic listing of permanent or temporary abandonment of water, oil, gas, test, exploration and waste injection wells, and may contain a well log, description of amounts and types of plugging material used, the method employed for plugging, a description of formations which are sealed and a graphic log of the well showing formation location, formation thickness, and location of plugging structures.\n\nPoint of injection for Class V wells  means the last accessible sampling point prior to waste fluids being released into the subsurface environment through a Class V injection well. For example, the point of injection of a Class V septic system might be the distribution box\u2014the last accessible sampling point before the waste fluids drain into the underlying soils. For a dry well, it is likely to be the well bore itself.\n\nPressure  means the total load or force per unit area acting on a surface.\n\nProject  means a group of wells in a single operation.\n\nRadioactive waste  means any waste which contains radioactive material in concentrations which exceed those listed in 10 CFR part 20, appendix B, table II column 2.\n\nRCRA  means the Solid Waste Disposal Act as amended by the Resource Conservation and Recovery Act of 1976 (Pub. L. 94-580, as amended by Pub. L. 95-609, 42 U.S.C. 6901  et seq.).\n\nSanitary waste  means liquid or solid wastes originating solely from humans and human activities, such as wastes collected from toilets, showers, wash basins, sinks used for cleaning domestic areas, sinks used for food preparation, clothes washing operations, and sinks or washing machines where food and beverage serving dishes, glasses, and utensils are cleaned. Sources of these wastes may include single or multiple residences, hotels and motels, restaurants, bunkhouses, schools, ranger stations, crew quarters, guard stations, campgrounds, picnic grounds, day-use recreation areas, other commercial facilities, and industrial facilities provided the waste is not mixed with industrial waste.\n\nSDWA  means the Safe Drinking Water Act (Pub. L. 95-523, as amended by Pub. L. 95-190, 42 U.S.C. 300(f)  et seq.).\n\nSeptic system  means a \u201cwell\u201d that is used to emplace sanitary waste below the surface and is typically comprised of a septic tank and subsurface fluid distribution system or disposal system.\n\nSite  means the land or water area where any facility or activity is physically located or conducted, including adjacent land used in connection with the facility or activity.\n\nSole or principal source aquifer  means an aquifer which has been designated by the Administrator pursuant to section 1424 (a) or (e) of the SDWA.\n\nState Director  means the chief administrative officer of any State, interstate, or Tribal agency operating an \u201capproved program,\u201d or the delegated representative of the State Director. If the responsibility is divided among two or more State, interstate, or Tribal agencies, \u201cState Director\u201d means the chief administrative officer of the State, interstate, or Tribal agency authorized to perform the particular procedure or function to which reference is made.\n\nStratum  (plural  strata ) means a single sedimentary bed or layer, regardless of thickness, that consists of generally the same kind of rock material.\n\nSubsidence  means the lowering of the natural land surface in response to: Earth movements; lowering of fluid pressure; removal of underlying supporting material by mining or solution of solids, either artificially or from natural causes; compaction due to wetting (Hydrocompaction); oxidation of organic matter in soils; or added load on the land surface.\n\nSubsurface fluid distribution system  means an assemblage of perforated pipes, drain tiles, or other similar mechanisms intended to distribute fluids below the surface of the ground.\n\nSurface casing  means the first string of well casing to be installed in the well.\n\nTotal dissolved solids  (\u201cTDS\u201d) means the total dissolved (filterable) solids as determined by use of the method specified in 40 CFR part 136.\n\nUIC  means the Underground Injection Control program under Part C of the Safe Drinking Water Act, including an \u201capproved program.\u201d\n\nUnderground injection  means a \u201cwell injection.\u201d\n\nUnderground source of drinking water  (USDW) means an aquifer or its portion:\n\n(1)(i) Which supplies any public water system; or\n\n(ii) Which contains a sufficient quantity of ground water to supply a public water system; and\n\n(A) Currently supplies drinking water for human consumption; or\n\n(B) Contains fewer than 10,000 mg/l total dissolved solids; and\n\n(2) Which is not an exempted aquifer.\n\nUSDW  means \u201cunderground source of drinking water.\u201d\n\nWell  means: A bored, drilled, or driven shaft whose depth is greater than the largest surface dimension; or, a dug hole whose depth is greater than the largest surface dimension; or, an improved sinkhole; or, a subsurface fluid distribution system.\n\nWell injection  means the subsurface emplacement of fluids through a well.\n\nWell plug  means a watertight and gastight seal installed in a borehole or well to prevent movement of fluids.\n\nWell stimulation  means several processes used to clean the well bore, enlarge channels, and increase pore space in the interval to be injected thus making it possible for wastewater to move more readily into the formation, and includes (1) surging, (2) jetting, (3) blasting, (4) acidizing, (5) hydraulic fracturing.\n\nWell monitoring  means the measurement, by on-site instruments or laboratory methods, of the quality of water in a well."], ["40:40:25.0.1.1.9.1.45.4", 40, "Protection of Environment", "I", "D", "146", "PART 146\u2014UNDERGROUND INJECTION CONTROL PROGRAM: CRITERIA AND STANDARDS", "A", "Subpart A\u2014General Provisions", "", "\u00a7 146.4 Criteria for exempted aquifers.", "EPA", "", "", "[45 FR 42500, June 24, 1980, as amended at 47 FR 4998, Feb. 3, 1982; 48 FR 14293, Apr. 1, 1983; 75 FR 77291, Dec. 10, 2010]", "An aquifer or a portion thereof which meets the criteria for an \u201cunderground source of drinking water\u201d in \u00a7 146.3 may be determined under \u00a7 144.7 of this chapter to be an \u201cexempted aquifer\u201d for Class I-V wells if it meets the criteria in paragraphs (a) through (c) of this section. Class VI wells must meet the criteria under paragraph (d) of this section:\n\n(a) It does not currently serve as a source of drinking water; and\n\n(b) It cannot now and will not in the future serve as a source of drinking water because:\n\n(1) It is mineral, hydrocarbon or geothermal energy producing, or can be demonstrated by a permit applicant as part of a permit application for a Class II or III operation to contain minerals or hydrocarbons that considering their quantity and location are expected to be commercially producible.\n\n(2) It is situated at a depth or location which makes recovery of water for drinking water purposes economically or technologically impractical;\n\n(3) It is so contaminated that it would be economically or technologically impractical to render that water fit for human consumption; or\n\n(4) It is located over a Class III well mining area subject to subsidence or catastrophic collapse; or\n\n(c) The total dissolved solids content of the ground water is more than 3,000 and less than 10,000 mg/l and it is not reasonably expected to supply a public water system.\n\n(d) The areal extent of an aquifer exemption for a Class II enhanced oil recovery or enhanced gas recovery well may be expanded for the exclusive purpose of Class VI injection for geologic sequestration under \u00a7 144.7(d) of this chapter if it meets the following criteria:\n\n(1) It does not currently serve as a source of drinking water; and\n\n(2) The total dissolved solids content of the ground water is more than 3,000 mg/l and less than 10,000 mg/l; and\n\n(3) It is not reasonably expected to supply a public water system."], ["40:40:25.0.1.1.9.1.45.5", 40, "Protection of Environment", "I", "D", "146", "PART 146\u2014UNDERGROUND INJECTION CONTROL PROGRAM: CRITERIA AND STANDARDS", "A", "Subpart A\u2014General Provisions", "", "\u00a7 146.5 Classification of injection wells.", "EPA", "", "", "[45 FR 42500, June 24, 1980, as amended at 46 FR 43161, Aug. 27, 1981; 47 FR 4999, Feb. 3, 1982; 64 FR 68573, Dec. 7, 1999; 75 FR 77291, Dec. 10, 2010]", "Injection wells are classified as follows:\n\n(a)  Class I.  (1) Wells used by generators of hazardous waste or owners or operators of hazardous waste management facilities to inject hazardous waste beneath the lowermost formation containing, within one quarter (\n 1/4 ) mile of the well bore, an underground source of drinking water.\n\n(2) Other industrial and municipal disposal wells which inject fluids beneath the lowermost formation containing, within one quarter mile of the well bore, an underground source of drinking water.\n\n(3) Radioactive waste disposal wells which inject fluids below the lowermost formation containing an underground source of drinking water within one quarter mile of the well bore.\n\n(b)  Class II.  Wells which inject fluids:\n\n(1) Which are brought to the surface in connection with conventional oil or natural gas production and may be commingled with waste waters from gas plants which are an integral part of production operations, unless those waters are classified as a hazardous waste at the time of injection.\n\n(2) For enhanced recovery of oil or natural gas; and\n\n(3) For storage of hydrocarbons which are liquid at standard temperature and pressure.\n\n(c)  Class III.  Wells which inject for extraction of minerals including:\n\n(1) Mining of sulfur by the Frasch process;\n\n(2) In situ production of uranium or other metals. This category includes only in-situ production from ore bodies which have not been conventionally mined. Solution mining of conventional mines such as stopes leaching is included in Class V.\n\n(3) Solution mining of salts or potash.\n\n(d)  Class IV.  (1) Wells used by generators of hazardous waste or of radioactive waste, by owners or operators of hazardous waste management facilities, or by owners or operators of radioactive waste disposal sites to dispose of hazardous waste or radioactive waste into a formation which within one quarter (\n 1/4 ) mile of the well contains an underground source of drinking water.\n\n(2) Wells used by generators of hazardous waste or of radioactive waste, by owners or operators of hazardous waste management facilities, or by owners or operators of radioactive waste disposal sites to dispose of hazardous waste or radioactive waste above a formation which within one quarter (\n 1/4 ) mile of the well contains an underground source of drinking water.\n\n(3) Wells used by generators of hazardous waste or owners or operators of hazardous waste management facilities to dispose of hazardous waste, which cannot be classified under \u00a7 146.05(a)(1) or \u00a7 146.05(d) (1) and (2) (e.g., wells used to dispose of hazardous wastes into or above a formation which contains an aquifer which has been exempted pursuant to \u00a7 146.04).\n\n(e)  Class V.  Injection wells not included in Class I, II, III, IV or VI. Specific types of Class V injection wells are also described in 40 CFR 144.81. Class V wells include:\n\n(1) Air conditioning return flow wells used to return to the supply aquifer the water used for heating or cooling in a heat pump;\n\n(2) Cesspools including multiple dwelling, community or regional cesspools, or other devices that receive wastes which have an open bottom and sometimes have perforated sides. The UIC requirements do not apply to single family residential cesspools nor to non-residential cesspools which receive solely sanitary wastes and have the capacity to serve fewer than 20 persons a day.\n\n(3) Cooling water return flow wells used to inject water previously used for cooling;\n\n(4) Drainage wells used to drain surface fluid, primarily storm runoff, into a subsurface formation;\n\n(5) Dry wells used for the injection of wastes into a subsurface formation;\n\n(6) Recharge wells used to replenish the water in an aquifer;\n\n(7) Salt water intrusion barrier wells used to inject water into a fresh water aquifer to prevent the intrusion of salt water into the fresh water;\n\n(8) Sand backfill and other backfill wells used to inject a mixture of water and sand, mill tailings or other solids into mined out portions of subsurface mines whether what is injected is a radioactive waste or not.\n\n(9) Septic system wells used to inject the waste or effluent from a multiple dwelling, business establishment, community or regional business establishment septic tank. The UIC requirements do not apply to single family residential septic system wells, nor to non-residential septic system wells which are used solely for the disposal of sanitary waste and have the capacity to serve fewer than 20 persons a day.\n\n(10) Subsidence control wells (not used for the purpose of oil or natural gas production) used to inject fluids into a non-oil or gas producing zone to reduce or eliminate subsidence associated with the overdraft of fresh water;\n\n(11) Radioactive waste disposal wells other than Class IV;\n\n(12) Injection wells associated with the recovery of geothermal energy for heating, aquaculture and production of electric power.\n\n(13) Wells used for solution mining of conventional mines such as stopes leaching;\n\n(14) Wells used to inject spent brine into the same formation from which it was withdrawn after extraction of halogens or their salts;\n\n(15) Injection wells used in experimental technologies.\n\n(16) Injection wells used for in situ recovery of lignite, coal, tar sands, and oil shale.\n\n(f)  Class VI. (1) The zone of endangering influence shall be:\n\n(i) In the case of application(s) for well permit(s) under \u00a7 122.38 that area the radius of which is the lateral distance in which the pressures in the injection zone may cause the migration of the injection and/or formation fluid into an underground source of drinking water; or\n\n(ii) In the case of an application for an area permit under \u00a7 122.39, the project area plus a circumscribing area the width of which is the lateral distance from the perimeter of the project area, in which the pressures in the injection zone may cause the migration of the injection and/or formation fluid into an underground source of drinking water.\n\n(2) Computation of the zone of endangering influence may be based upon the parameters listed below and should be calculated for an injection time period equal to the expected life of the injection well or pattern. For these wells, the Director shall prescribe a monitoring program which will verify the absence of significant fluid movement from the injection zone into an USDW.\n\n(c) One of the following methods must be used to determine the absence of significant fluid movement under paragraph (a)(2) of this section:\n\n(1) The results of a temperature or noise log; or\n\n(2) For Class II only, cementing records demonstrating the presence of adequate cement to prevent such migration; or\n\n(3) For Class III wells where the nature of the casing precludes the use of the logging techniques prescribed at paragraph (c)(1) of this section, cementing records demonstrating the presence of adequate cement to prevent such migration;\n\n(4) For Class III wells where the Director elects to rely on cementing records to demonstrate the absence of significant fluid movement, the monitoring program prescribed by \u00a7 146.33(b) shall be designed to verify the absence of significant fluid movement.\n\n(d) The Director may allow the use of a test to demonstrate mechanical integrity other than those listed in paragraphs (b) and (c)(2) of this section with the written approval of the Administrator. To obtain approval, the Director shall submit a written request to the Administrator, which shall set forth the proposed test and all technical data supporting its use. The Administrator shall approve the request if it will reliably demonstrate the mechanical integrity of wells for which its use is proposed. Any alternate method approved by the Administrator shall be published in the  Federal Register  and may be used in all States unless its use is restricted at the time of approval by the Administrator.\n\n(e) In conducting and evaluating the tests enumerated in this section or others to be allowed by the Director, the owner or operator and the Director shall apply methods and standards generally accepted in the industry. When the owner or operator reports the results of mechanical integrity tests to the Director, he shall include a description of the test(s) and the method(s) used. The casing and cement used in the construction of each newly drilled well shall be designed for the life expectancy of the well. In determining and specifying casing and cementing requirements, the following factors shall be considered:\n\n(1) Depth to the injection zone;\n\n(2) Injection pressure, external pressure, internal pressure, and axial loading;\n\n(3) Hole size;\n\n(4) Size and grade of all casing strings (wall thickness, diameter, nominal weight, length, joint specification, and construction material);\n\n(5) Corrosiveness of injected fluid, formation fluids, and temperatures;\n\n(6) Lithology of injection and confining intervals; and\n\n(7) Type or grade of cement.\n\n(c) All Class I injection wells, except those municipal wells injecting non-corrosive wastes, shall inject fluids through tubing with a packer set immediately above the injection zone, or tubing with an approved fluid seal as an alternative. The tubing, packer, and fluid seal shall be designed for the expected service.\n\n(1) The use of other alternatives to a packer may be allowed with the written approval of the Director. To obtain approval, the operator shall submit a written request to the Director, which shall set forth the proposed alternative and all technical data supporting its use. The Director shall approve the request if the alternative method will reliably provide a comparable level of protection to underground sources of drinking water. The Director may approve an alternative method solely for an individual well or for general use.\n\n(2) In determining and specifying requirements for tubing, packer, or alternatives the following factors shall be considered:\n\n(i) Depth of setting;\n\n(ii) Characteristics of injection fluid (chemical content, corrosiveness, and density);\n\n(iii) Injection pressure;\n\n(iv) Annular pressure;\n\n(v) Rate, temperature and volume of injected fluid; and\n\n(vi) Size of casing.\n\n(d) Appropriate logs and other tests shall be conducted during the drilling and construction of new Class I wells. A descriptive report interpreting the results of such logs and tests shall be prepared by a knowledgeable log analyst and submitted to the Director. At a minimum, such logs and tests shall include:\n\n(1) Deviation checks on all holes constructed by first drilling a pilot hole, and then enlarging the pilot hole by reaming or another method. Such checks shall be at sufficiently frequent intervals to assure that vertical avenues for fluid migration in the form of diverging holes are not created during drilling.\n\n(2) Such other logs and tests as may be needed after taking into account the availability of similar data in the area of the drilling site, the construction plan, and the need for additional information, that may arise from time to time as the construction of the well progresses. In determining which logs and tests shall be required, the following logs shall be considered for use in the following situations:\n\n(i) For surface casing intended to protect underground sources of drinking water:\n\n(A) Resistivity, spontaneous potential, and caliper logs before the casing is installed; and\n\n(B) A cement bond, temperature, or density log after the casing is set and cemented.\n\n(ii) For intermediate and long strings of casing intended to facilitate injection:\n\n(A) Resistivity, spontaneous potential, porosity, and gamma ray logs before the casing is installed;\n\n(B) Fracture finder logs; and\n\n(C) A cement bond, temperature, or density log after the casing is set and cemented.\n\n(e) At a minimum, the following information concerning the injection formation shall be determined or calculated for new Class I wells:\n\n(1) Fluid pressure;\n\n(2) Temperature;\n\n(3) Fracture pressure;\n\n(4) Other physical and chemical characteristics of the injection matrix; and\n\n(5) Physical and chemical characteristics of the formation fluids."], ["40:40:25.0.1.1.9.2.45.3", 40, "Protection of Environment", "I", "D", "146", "PART 146\u2014UNDERGROUND INJECTION CONTROL PROGRAM: CRITERIA AND STANDARDS", "B", "Subpart B\u2014Criteria and Standards Applicable to Class I Wells", "", "\u00a7 146.13 Operating, monitoring and reporting requirements.", "EPA", "", "", "[45 FR 42500, June 24, 1980, as amended at 46 FR 43162, Aug. 27, 1981; 47 FR 32129, July 26, 1982; 53 FR 28148, July 26, 1988]", "(a)  Operating requirements.  Operating requirements shall at a minimum, specify that:\n\n(1) Except during stimulation injection pressure at the wellhead shall not exceed a maximum which shall be calculated so as to assure that the pressure in the injection zone during injection does not initiate new fractures or propagate existing fractures in the injection zone. In no case shall injection pressure initiate fractures in the confining zone or cause the movement of injection or formation fluids into an underground source of drinking water.\n\n(2) Injection between the outermost casing protecting underground sources of drinking water and the well bore is prohibited.\n\n(3) Unless an alternative to a packer has been approved under \u00a7 146.12(c), the annulus between the tubing and the long string of casings shall be filled with a fluid approved by the Director and a pressure, also approved by the Director, shall be maintained on the annulus.\n\n(b)  Monitoring requirements.  Monitoring requirements shall, at a minimum, include:\n\n(1) The analysis of the injected fluids with sufficient frequency to yield representative data of their characteristics;\n\n(2) Installation and use of continuous recording devices to monitor injection pressure, flow rate and volume, and the pressure on the annulus between the tubing and the long string of casing;\n\n(3) A demonstration of mechanical integrity pursuant to \u00a7 146.8 at least once every five years during the life of the well; and\n\n(4) The type, number and location of wells within the area of review to be used to monitor any migration of fluids into and pressure in the underground sources of drinking water, the parameters to be measured and the frequency of monitoring.\n\n(c)  Reporting requirements.  Reporting requirements shall, at a minimum, include:\n\n(1) Quarterly reports to the Director on:\n\n(i) The physical, chemical and other relevant characteristics of injection fluids;\n\n(ii) Monthly average, maximum and minimum values for injection pressure, flow rate and volume, and annular pressure; and\n\n(iii) The results of monitoring prescribed under paragraph (b)(4) of this section.\n\n(2) Reporting the results, with the first quarterly report after the completion, of:\n\n(i) Periodic tests of mechanical integrity;\n\n(ii) Any other test of the injection well conducted by the permittee if required by the Director; and\n\n(iii) Any well work over.\n\n(d)  Ambient monitoring.  (1) Based on a site-specific assessment of the potential for fluid movement from the well or injection zone and on the potential value of monitoring wells to detect such movement, the Director shall require the owner or operator to develop a monitoring program. At a minimum, the Director shall require monitoring of the pressure buildup in the injection zone annually, including at a minimum, a shut down of the well for a time sufficient to conduct a valid observation of the pressure fall-off curve.\n\n(2) When prescribing a monitoring system the Director may also require:\n\n(i) Continuous monitoring for pressure changes in the first aquifer overlying the confining zone. When such a well is installed, the owner or operator shall, on a quarterly basis, sample the aquifer and analyze for constituents specified by the Director;\n\n(ii) The use of indirect, geophysical techniques to determine the position of the waste front, the water quality in a formation designated by the Director, or to provide other site specific data;\n\n(iii) Periodic monitoring of the ground water quality in the first aquifer overlying the injection zone;\n\n(iv) Periodic monitoring of the ground water quality in the lowermost USDW; and\n\n(v) Any additional monitoring necessary to determine whether fluids are moving into or between USDWs."], ["40:40:25.0.1.1.9.2.45.4", 40, "Protection of Environment", "I", "D", "146", "PART 146\u2014UNDERGROUND INJECTION CONTROL PROGRAM: CRITERIA AND STANDARDS", "B", "Subpart B\u2014Criteria and Standards Applicable to Class I Wells", "", "\u00a7 146.14 Information to be considered by the Director.", "EPA", "", "", "[45 FR 42500, June 24, 1980, as amended at 46 FR 43162, Aug. 27, 1981; 48 FR 14293, Apr. 1, 1983]", "This section sets forth the information which must be considered by the Director in authorizing Class I wells. For an existing or converted new Class I well the Director may rely on the existing permit file for those items of information listed below which are current and accurate in the file. For a newly drilled Class I well, the Director shall require the submission of all the information listed below. For both existing and new Class I wells certain maps, cross-sections, tabulations of wells within the area of review and other data may be included in the application by reference provided they are current, readily available to the Director (for example, in the permitting agency's files) and sufficiently identified to be retrieved. In cases where EPA issues the permit all the information in this section must be submitted to the Administrator.\n\n(a) Prior to the issuance of a permit for an existing Class I well to operate or the construction or conversion of a new Class I well the Director shall consider the following:\n\n(1) Information required in 40 CFR 144.31 and 144.31(g);\n\n(2) A map showing the injection well(s) for which a permit is sought and the applicable area of review. Within the area of review, the map must show the number, or name, and location of all producing wells, dry holes, surface bodies of water, springs, mines (surface and subsurface), quarries, water wells and other pertinent surface features including residences and roads. The map should also show faults, if known or suspected. Only information of public record is required to be included on this map;\n\n(3) A tabulation of data on all wells within the area of review which penetrate into the proposed injection zone. Such data shall include a description of each well's type, construction, date drilled, location, depth, record of plugging and/or completion, and any additional information the Director may require;\n\n(4) Maps and cross sections indicating the general vertical and lateral limits of all underground sources of drinking water within the area of review, their position relative to the injection formation and the direction of water movement, where known, in each underground source of drinking water which may be affected by the proposed injection;\n\n(5) Maps and cross sections detailing the geologic structure of the local area;\n\n(6) Generalized maps and cross sections illustrating the regional geologic setting;\n\n(7) Proposed operating data:\n\n(i) Average and maximum daily rate and volume of the fluid to be injected;\n\n(ii) Average and maximum injection pressure; and\n\n(iii) Source and an analysis of the chemical, physical, radiological and biological characteristics of injection fluids;\n\n(8) Proposed formation testing program to obtain an analysis of the chemical, physical and radiological characteristics of and other information on the receiving formation;\n\n(9) Proposed stimulation program;\n\n(10) Proposed injection procedure;\n\n(11) Schematic or other appropriate drawings of the surface and subsurface construction details of the well.\n\n(12) Contingency plans to cope with all shut-ins or well failures so as to prevent migration of fluids into any underground source of drinking water;\n\n(13) Plans (including maps) for meeting the monitoring requirements in \u00a7 146.13(b);\n\n(14) For wells within the area of review which penetrate the injection zone but are not properly completed or plugged, the corrective action proposed to be taken under 40 CFR 144.55;\n\n(15) Construction procedures including a cementing and casing program, logging procedures, deviation checks, and a drilling, testing, and coring program; and\n\n(16) A certificate that the applicant has assured, through a performance bond or other appropriate means, the resources necessary to close, plug or abandon the well as required by 40 CFR 122.42(g).\n\n(b) Prior to granting approval for the operation of a Class I well the Director shall consider the following information:\n\n(1) All available logging and testing program data on the well;\n\n(2) A demonstration of mechanical integrity pursuant to \u00a7 146.8;\n\n(3) The anticipated maximum pressure and flow rate at which the permittee will operate;\n\n(4) The results of the formation testing program;\n\n(5) The actual injection procedure;\n\n(6) The compatibility of injected waste with fluids in the injection zone and minerals in both the injection zone and the confining zone; and\n\n(7) The status of corrective action on defective wells in the area of review.\n\n(c) Prior to granting approval for the plugging and abandonment of a Class I well the Director shall consider the following information:\n\n(1) The type and number of plugs to be used;\n\n(2) The placement of each plug including the elevation of the top and bottom;\n\n(3) The type and grade and quantity of cement to be used;\n\n(4) The method for placement of the plugs; and\n\n(5) The procedure to be used to meet the requirement of \u00a7 146.10(c)."], ["40:40:25.0.1.1.9.2.45.5", 40, "Protection of Environment", "I", "D", "146", "PART 146\u2014UNDERGROUND INJECTION CONTROL PROGRAM: CRITERIA AND STANDARDS", "B", "Subpart B\u2014Criteria and Standards Applicable to Class I Wells", "", "\u00a7 146.15 Class I municipal disposal well alternative authorization in certain parts of Florida.", "EPA", "", "", "[70 FR 70531, Nov. 22, 2005]", "(a) Existing Class I municipal disposal wells in specific geographic regions as defined in paragraph (f) of this section may continue to inject without violating the regulatory prohibitions in Parts 144 and 146 of this chapter against the movement of injection or formation fluids into a USDW, provided that such wells meet the requirements of this section, even if the Director determines they have caused or may cause fluid movement into a USDW. Nothing in this section excuses such Class I municipal disposal wells from meeting all other applicable State and Federal requirements including 40 CFR 144.12(a).\n\n(b) For purposes of this section, an existing Class I municipal disposal well is defined as a well for which a complete UIC construction permit application was received by the Director on or before December 22, 2005.\n\n(c) For purposes of this section, the determination that a Class I municipal disposal well has caused or may cause movement of injection or formation fluids into a USDW may be made by the Director based on any relevant data available to him/her, including ground water monitoring data generated pursuant to regulatory requirements governing operation of Class I municipal disposal wells.\n\n(d) In order for a Class I municipal disposal well to qualify for authorization to inject pursuant to paragraph (a) of this section, the Owner/Operator of that well shall:\n\n(1) Develop and implement a pretreatment program that is no less stringent than the requirements of Chapter 62-625, Florida Administrative Code, or have no significant industrial users as defined in that chapter.\n\n(2) Treat the injectate using secondary treatment in a manner that is no less stringent than the requirements of Florida Rule 62-600.420(1)(d), and using high-level disinfection in a manner that is no less stringent than the requirements of Florida Rule 62-600.440(5)(a)-(f), within five years after notification by the Director that the well has caused or may cause fluid movement into a USDW.\n\n(e) Where the Director issued such notice for a well prior to December 22, 2005, in order for that well to qualify for authorization to inject pursuant to paragraph (a) of this section, the Owner/Operator shall:\n\n(1) Develop and implement a pretreatment program that is no less stringent than the requirements of Chapter 62-625, Florida Administrative Code, or have no significant industrial users as defined in that chapter; and\n\n(2) Treat the injectate using secondary treatment in a manner that is no less stringent than the requirements of Florida Rule 62-600.420(1)(d), and using high-level disinfection in a manner that is no less stringent than the requirements of Florida Rule 62-600.440(5)(a)-(f), within five years after December 22, 2005.\n\n(f) Authorization to inject wastewater into existing Class I municipal disposal wells pursuant to this section is limited to Class I municipal disposal wells in Florida in the following counties: Brevard, Broward, Charlotte, Collier, Flagler, Glades, Hendry, Highlands, Hillsborough, Indian River, Lee, Manatee, Martin, Miami-Dade, Monroe, Okeechobee, Orange, Osceola, Palm Beach, Pinellas, St. Johns, St. Lucie, Sarasota, and Volusia."]],
