This legislation included provisions that increased the H-2B visa program's cap limit. When American workers are unwilling to take on these seasonal positions, clubs turn to the H-2B program. Without these workers, many clubs are unable to fully staff their facilities. This provision was included in the final bill. NCA also lobbied on H.R. 1625 for legislative language that would have overturned the National Labor Relations Board's "Joint Employer" decision. This language would have returned the definition of a joint employer to the standard used prior to the NLRB's ruling in 2015. This language was not included in the final bill. NCA also lobbied for H.R. 3956, the Simplifying Technical Aspects Regarding Seasonality Act. This legislation will remove the two different definitions for seasonal staffers currently found in the Affordable Care Act. By so doing, club leaders will better understand who must be counted when determining if their facility has 50 or more full-time or full-time equivalent employees and who is then required to be offered health insurance under the law. | HOUSE OF REPRESENTATIVES,SENATE | 0 | 0 | 2018-04-09T14:50:49.550000-04:00 |
