This regulation places golf course waterways and ponds under the control of the Clean Water Act (CWA) for the very first time. Under the CWA, private golf and country clubs will be forced to refrain from using standard and traditional pesticides and fertilizers without first securing permits from the EPA. In addition to permitting requirements, this new rule adds numerous regulatory burdens on clubs that could increase costs and cause a loss of jobs in the club industry all without significant benefit to the newly protected water.
