The bill will change the definition of full-time employee found in the Affordable Care Act from 30 hours per week to 40 hours per week. With this change, NCA member clubs will minimize health insurance costs that otherwise could cause them to reduce hours for employees or layoff workers. NCA also lobbied for HR 4238, a bill to stop the Department of Labor (DOL) from implementing any further changes to the H-2B visa program. DOL plans to issuea new wage rule that would make the program too expensive for NCA member clubs to use. This bill would prohibit that from happening and prohibit a proposed H-2B overhaul rule from being issued by DOL. Without this legislation, NCA member clubs would be left unable to fully staff their facilities during their high seasons. Also, NCA lobbied for passage of the Workforce Democracy Fairness Act, HR 4320. This bill would prohibit the National Labor Relations Board's Ambush Election Rule from being implemented. That rule would allow union organizers to hold an election within 10-21 days from the day the election petition is filed. Such a time frame would make it impossible for NCA member clubs to defend against the union campaign and it would limit the ability of NCA member clubs' employees to understand what union representation would really mean. Finally, NCA lobbied for a technical correction to the Affordable Care Act as it relates to seasonal workers. NCA member clubs use a tremendous number of such workers and the current language in the law and regulations provide two separate exemption periods for these workers and a confusing and complex set of requirements for counting these workers. To ensure compliance with the law when it applies to these workers, we have supported making a change to the law.
